There's a distinct pattern, it doesn't look like he was ever out long enough to actually be forced over to carrier payments for TTD, and it doesn't appear he had any perm, either. He stayed out long enough that he got his full pay under his company benefits, then when those were up, he went back to work and got injured again.

I also handled WC claims for years. Had his file landed on my desk, you can bet I'd have had someone watching him.Jobeth66https://www.blogger.com/profile/11038439425452956832noreply@blogger.comtag:blogger.com,1999:blog-6757696342634699253.post-68117108691930451932009-08-25T20:47:16.149-07:002009-08-25T20:47:16.149-07:00You are wise, caligirl, to avoid riding, although ...You are wise, caligirl, to avoid riding, although as a rider myself I can hugely commiserate!

I also know of a guy who had a huge WC claim, and a lawsuit, too (my hubby worked with him on a jobsite), got caught at a tall commercial construction project hopping around the scaffolding like a baboon on steroids- so much for his horrible chronic pain and "can barely get out of bed"! He had rooked WC for thousands already, and I believe he had to pay a big chunk of it back, it was all on tape!

Liars lie (and lie, and lie...). I hope they produce a big Power Point presentation at the end of this, with all the proven ones he's told right out there in a nice, long, list.Summer's Momhttps://www.blogger.com/profile/11779596467816839451noreply@blogger.comtag:blogger.com,1999:blog-6757696342634699253.post-10755699069110181702009-08-25T13:17:55.499-07:002009-08-25T13:17:55.499-07:00Having been involved with both sides of worker'...Having been involved with both sides of worker's comp (as an injured employee for the Department of Corrections and as a worker's comp case manager), someone would have had to voice suspicions about Brown's activities while on TTD. I had clients that I was suspicious about and they were surveilled ...
My own back doctor told me that it was dangerous for me to continue to ride horses, not only because of my back injury itself and how a fall could further damage my fused lower back, but because riding could call the extent of my injury into question. I'd ridden horses for nearly 25 years at the time of my injury. Not any more. I've not been on the back of a horse in 15 years.
The extent of the damage to Lauren was disgusting. She didn't just slip and fall ... Brown will be a very popular inmate while spending the rest of his life in the Department of Corrections' custody.CaliGirl9https://www.blogger.com/profile/06639398512708841968noreply@blogger.comtag:blogger.com,1999:blog-6757696342634699253.post-55650473870748983562009-08-25T09:37:43.987-07:002009-08-25T09:37:43.987-07:00If he was on workers' compensation, they have ...If he was on workers' compensation, they have investigators who do spot checks for exactly this type of activity. Even if AA was paying his wages, they would have had to report his claim to their WC carrier, and report on his return to work.Jobeth66https://www.blogger.com/profile/11038439425452956832noreply@blogger.comtag:blogger.com,1999:blog-6757696342634699253.post-16564117886138191372009-08-25T09:21:31.200-07:002009-08-25T09:21:31.200-07:00No,no, I wouldn't expect AA to know, either, b...No,no, I wouldn't expect AA to know, either, but my point goes to the over-all credibility/reliability of the defendant- he himself was concerned he might be followed and video-recorded by someone for AA (not that that stopped him from surfing). Just more going to character (or lack thereof, in this case).Summer's Momhttps://www.blogger.com/profile/11779596467816839451noreply@blogger.comtag:blogger.com,1999:blog-6757696342634699253.post-85746860492672464382009-08-25T08:23:01.509-07:002009-08-25T08:23:01.509-07:00If your employee is going to his doctor, and the d...If your employee is going to his doctor, and the doctor's reports are that your employee is still "injured," how would AA know to follow the employee to see what his activities were?

I don't know "how" AA monitored their employees on a injury disability. I work for a delivery company, also physically-intensive labor- they would very much look askance if I were seen, say, water-skiing while on injury leave.Summer's Momhttps://www.blogger.com/profile/11779596467816839451noreply@blogger.com
