The judge said he could FedEx them. If it's allowable, he could get the info to the expert more simply and quickly than that if it's not hundreds of pages. Photos and documents can be quickly scanned and emailed, and he probably already HAS them in electronic form, in any case. <br /><br />Any attorney's office that didn't have at least simple scanner would be laughable. You can walk into any electronics store or even discount store and buy an inexpensive one off-the-shelf. I bought one for my mother from Newegg.com for $59 (I've used them for years and highly recommend them for that kind of thing). Heck, you can even buy a combination scanner/fax/printer to really get your money's worth. JB has NO valid excuses for not getting these things done in a timely manner. What an ass!<br /><br />Going for "insufficient counsel" would also be shooting himself in the foot, as it only advertises just how inept he really IS. In this case, his ineptness would be broadcast all over the world. Hardly a ringing endorsement for future business, so I don't think he would do that unless he had a very rich client (he doesn't) who paid him off enough that he would be set for life. And even then all that would happen would be yet another trial; it's not like Casey would go free, so what would be the point? Unless he plans to be known for that kind of thing so that he can explain to potential death penalty clients that he could delay impending death in that manner. It's called self-awareness. It's about preparation, thorough preparation.<br /><br />Having taught at the secondary level for over 30 years, I can't remember a time when I wasn't prepared to teach a class. There were just as many hours spent on preparation as execution.<br /><br />As for deadlines, they were DEADlines. That Mr. Baez doesn't come to a status hearing well-prepared galls me. The stakes are high and he doesn't remember key dates? He doesn't remember how many reports have to be submitted. He doesn't prepare by contacting his experts. He stated that his "efforts" to contact Dr. Logan were "sufficient", relying on his e-mail messages and voice mails. <br /><br />As this is a case with serious consequences, "sufficient" isn't good enough.<br /><br />I'm all fired up and ready to write. As to the reports: based on my layman's experience at trial-watching and reading a lot about the law, if an expert gives an opinion that jibes with the defense, a report will quickly follow. It is then used t put the defense case together. If the expert has nothing to offer the defense, there is no report. Make your own conclusion. <br /><br />If you go back to Linda Kenney-Baden's original role in the case, THE SCIENCE, she asked for everything possible in extensive motions. She got whatever she was legally allowed to have. Also note that she left the team last year because her job was done. <br /><br />Also, we have seen neither hide nor hair of Dorothy Clay Sims, who seems to be taking over LKB's role. She's used to working with people in the medical profession as experts, she would know how to deal with expert reports and court-ordered deadlines.<br /><br />The final part of my article should be up later today. I have a feeling he will, but it goes against what all the people with common sense would do right? That answers the reasons why there is a possibility JB would do it. <br /><br />Ritanita, I have to say that I don't believe a single word says at the hearings, he is so full of it. <br /><br />I have my doubts JB doesn't have Dr. Spitz and Kathy Reichs' reports.
