It was what drew me into this trial, I'd never seen anything like it. Cutler asked for more time before presenting his opening arguments after AJ was done....he said he felt "denuded". LOL! IIRC Fidler gave him a half hour and said something like "The state has no obligation to tell you what their opening will be." This was the first time that I got an inkling what trial strategy really is! To find this information I was pleasantly surprised all the statements and coverage of the first trial was at http://www.courttv.com/trials/spector/index.html The "I didn't mean to shoot her, it was an accident" was from the ugly mouth of PS at the ugly castle during his arrest. PS states later "it was an accident" during a recorded disposition later at the castle. I think the defense was planning on the prosecution opening with these statements. It surprised the defense team when they didn't and they asked for more time. I already reported during my coverage of day two of voir dire that Chris Plourd is no longer on the case.<BR/><BR/>Rachelle did wear her brightest colored outfit to date ~for trial #2~ on Thursday afternoon. At first I thought it was navy blue and white seersucker looking, but all the accessories were black and white so it wasn't navy. It was more white than black. A pantsuit with a short sleeved fitted jacket, white trim around the sleeves, matching fabric belt with white piping around the edge and black and white patent leather heels.<BR/><BR/>The only thing I can say about Spector's outfits are, they are the same as what he wore during the first trial, but it's mostly navy, charcoal and black suits. There's not been anything too shocking in the way of ties, either.<BR/><BR/>It appears the defense team doesn't eat lunch with Spector like the first team did. A few times I've seen Weinberg and his staff eat in the cafeteria together. Spector always leaves the building, and not always with people who've come to support him.<BR/><BR/>There are way fewer people sitting on the defense side of the room this time, which means often times, Rachelle is sitting by herself. The bodyguard doesn't sit by her. He sits in the back of the courtroom, near the door.<BR/><BR/>I don't know if many remember, but it was not apparent to the jurors who she is. The jury does not see them together. They will at the viewing of the crime scene, but even then, Spector and Rachelle are , IIRC, not supposed to talk or anything like that. I seem to recall that Juror #9 from the first trial, thought that she might have been her daughter.<BR/><BR/>I'm being called to get ready! He is uncovering every inconsistency in witness statements that he can and presenting them to the jury. I don't honestly know if Weinberg has made more motions for a mistrial than the prior legal team did. I didn't keep count. I've considered having a pool to see if anyone can guess the total number of times Weinberg does ask for one. However, I don't know "exactly" how many times he's asked for a mistrial to date.<BR/><BR/>Please understand that what Weinberg is doing is "preserving the record" for his client. Even Judge Fidler acknowledged that at one point in the trial. If Weinberg doesn't make objections or motions for mistrial <I>during the trial</I> then the consideration for appeal by the upper courts on those grounds (specific argument) are lost.<BR/><BR/>Whether Weinberg will be able to convince 12 jurors that there is "reasonable doubt" in this case remains to be seen.<BR/><BR/>So far imho, Weinberg has not be able to sway De Souza's testimony or ruffle his demeanor on the stand. De Souza has been rock solid. <BR/><BR/>Testimony ended early Friday because I believe a juror had an appointment. It ended at 2:45 pm. On redirect, the prosecution was able to get in just in time, the entire taped interview LE did with De Souza at the police station before court ended for the holiday break.<BR/><BR/>Court resumes December 1st, at 9:30 am. Over the holiday break, I will be updating some of the older entries as well as get the notes up that I have on De Souza. I will put up a notice entry when an old entry is updated.<BR/><BR/>Please be forewarned that for the month of December, I will not be able to put up detailed entries. I have too much sewing to do to be able to do both. My commitment to covering this trial has taken a big bite into my responsibilities at home. The house is a mess right now, and it's a struggle to keep the house in a semblance of order because I am so tired from sitting on the hard benches. I don't think I will be able to have company until this case is over and I can give my house a proper cleaning.<BR/><BR/>During December, I will post highlights of each day's testimony, and let you know who was on the witness stand. In January, once the holidays are over, I hope to go back to posting longer, detailed entries.
