Casey Anthony Faces Civil Suits And Costs

I've managed to move on and now I am seeing the aftermath of Casey's not guilty verdicts. As is my personal preference, I am limiting coverage to the various lawsuits and financial issues that she will be facing for the near future.

On August 25th at 9:00 AM, there will be a hearing in which the prosecution will present the costs of the investigation. If you go back to the sentencing (part 1, part 2) Judge Belvin Perry laid out the lies Casey told to investigators and stressed the resources that LE put forth to find a missing child based on those lies. As we learned from the fraud hearing, there were fees attached. The last we heard about that was the hearing where it was discussed with Judge Stan Strickland. How much Casey would have to pay fell by the wayside as the murder trial loomed.

Next, Casey has to face the civil suit filed by Zenaida Gonzalez in 2008 for defamation. John Morgan served a subpoena to Casey and her civil attorney, Charles M. Greene for her to do a deposition on July 19, 2011 at his offices. Yesterday, he filed an emergency motion asking Judge Jose Rodriguez to allow him to take her deposition in the jail prior to her release. He based the motion on the fact that it has become known that it is likely that Casey will leave the jurisdiction upon her release and possibly adopt a new name and new appearance.

Her attorney has stated that he objects to the motion and that he considers it a"publicity stunt" that is "abusing the court process." He said he would not attend the deposition unless ordered to by the judge.

Next up is the TES motion filed by Tim Miller on July 12. In it, he is asking for reimbursement for the expenditures made in the search for Caylee Anthony. Although the amount he is asking is not in the motion, Mr. Miller has stated on various programs that the expenses ran about $112,000. He also stated that he is asking for an Internal Revenue audit of his books to back up his claims.

The motion is based upon the representations made to him by the Anthony family when he traveled to Orlando to assess the situation. Some key points he made in his motion were that:

P. 4, #25: Based on Cindy Anthony's request, Mr. Miller travelled to Orlando, Florida and met with CASEY ANTHONY, her parents, Cindy and George Anthony, and CASEY ANTHONY's attorney, Jose Baez, to determine whether or not TES could help with the search for Caylee, and whether it should dedicate its limited resources to the case.

P. 4, #26: Mr. Miller met with the Anthony family, including CASEY ANTHONY, Cindy and George Anthony told Mr. Miller, in the presence of CASEY ANTHONY, that Caylee was still alive. CASEY ANTHONY did not correct, question or otherwise comment on the representations made by her parents, Cindy and George Anthony, that Caylee was alive. In fact, CASEY ANTHONY likewise told Mr. Miller that Caylee was alive, and asked him to please bring her back.

There are over 40 paragraphs in the suit and well worth reading. TES is suing on two counts, FRAUD and UNJUST ENRICHMENT.

Jose Baez' opening statement to the court will come back to slap Casey if Mr. Miller and TES prevail in this suit:

P. 8 #55: CASEY ANTHONY gladly accepted the benefits conferred upon her by TES knowing, all the time that her daughter was deceased and that the search for her daughter was unnecessary, particularly to the extent that searchers were looking for a live child.

I was listening to InSession when Leonard Padilla announced that he is considering suing Casey Anthony for $200,000. Another one jumps on the bandwagon.

Finally, let's not forget that Casey has a tax lien against her for about $70,000 in unpaid income tax for the $200,000 she earned in 2008 by selling her daughter's pictures and videos to ABC.

The Case Against Casey Anthony: Judge Strickland Rules on Tim Miller

UPDATE!

Leonard Padilla & Co.

WESH is reporting that Judge Strickland denied the defense motion to keep Leonard Padilla and his people from testifying at trial or giving depositions.

In his ruling, Judge Strickland indicated that the language in the agreement was vague as to the nature of "privacy" and indicated that the parties to the agreement seemed to be in agreement as to what it meant.

Strickland cited the definition of privacy as:

...the right to be let alone and free from governmental intrusion into the person's private life... Article 1, Section 23 (Fla. Const.)

He also indicated that the services rendered by Padilla & Co.

...would appear to encompass only general responsibilities normally associated with security, ie.e., preventing unwanted intrusions, and providing protection from threats of physical violence as detailed by George Anthony.

The section of the decision which clinched it was the fact that

... the agreement states, inter alia...

This agreement does not create a relationship in so far as that (sic) the parties fo the second part are in no way hired by or represent the firm or the defendant. (Privacy Agreement, August 19th, 2008, p. 2)

The language referenced above would seemingly negate any agency agreement under 90.502, Fla Stat.

It would seem that Jose Baez was defeated by his own language and his own witness.

Tim Miller

Judge Stan Strickland has ruled on the first of three motions that remained unresolved at the end of Friday's hearing.

In the hearing, Tim Miller's attorney, Mark NeJame had indicated that Tim Miller was willing to offer to have Miller turn over information pertaining to 32 searchers who had searched within 200 yards of the actual crime scene and come to Florida to give a deposition in the case.

Theses offers have been encompassed in the ruling.

In addition, the defense will have the opportunity to examine the documents pertaining to the other searchers in NeJame's office. The court will also appoint a monitor, at the defense's expense. NeJame will also have the right to monitor the review.

If the defense is able to identify any other searchers who were

"in the immediate proximity of where the remains of Caylee Marie Anthony were found, said searchers may be presented to the Court for an in camera review and inspection so that a decision can be made by the Court to determine materiality, relevance, and possible disclosure."

The defense will not be permitted to take notes or photograph the information. The judge will have to approve any disclosure or release made about any of this information.

Casey Anthony is responsible for all expenses, which must be paid in advance.

While this is a "victory" for the defense, it is also a victory for TES. The judge, in his ruling, agreed with NeJame and what we see is what NeJame asked for.

What is best here is that Judge Strickland limited any additional searchers to the immediate proximity of the crime scene, although he does not give an actual distance.

Watch T&T for updates on the other motions still being considered by Judge Strickland.

Casey Anthony: August 21 Hearing Report

Watching the hearing Friday, I had the feeling I was watching a preview of the trial. The defense made it crystal clear what the defense case is going to be. In his early remarks concerning the Motion To Certify Timothy Miller As a Material Witness, California attorney Todd Macaluso came right out and said:

As Your Honor knows, the body of Caylee Marie Anthony was found very close to the Anthony home, and the body was found in a wooded area that if one were to search for a missing child, this is the first place you would go search. There is substantial evidence that we’ve discovered, and that’s been set forth in our brief, Your Honor, that the body or the remains of Caylee Anthony were placed there after Casey Anthony was locked up in the Orange County Correctional Facility. There is substantial evidence, and that proves, Your Honor, her innocence. That’s exculpatory evidence, it proves that somebody else placed the remains in the area where it was ultimately found.

As I was watching, my mind went through all the holes in this defense and I couldn’t believe that Casey’s “all-star” defense thinks they will find any sort of evidence to bolster it. Way back in the beginning of the case and during it’s continuing “media-o-rama,” I recall Jose Baez constantly reassuring us that Casey had very compelling reasons for doing what she did and that we would have to wait for the trial to hear them. I guess they are still looking for those “compelling” reasons. From Casey’s appearance today, I have a feeling that she may have forgotten what her “compelling” reason was and is looking to her team of attorneys to come up with one for her.

Macaluso went on to describe the extensive search of the area and explain that since this is a capital murder case, it is incumbent on the defense to question everyone in the search. He went on and on and concluded that the evidence they would unearth would be exculpatory because it would prove Casey is innocent. He argued that if a person volunteered to search for a missing child and found the child, the remains, or evidence, there would be no expectation of privacy because the person would be a material witness. He continued by stating that if there were 32 or 100 persons who searched the area and found nothing, didn’t smell decomposition, that was also evidence. Macaluso also mentioned that a while ago, a Team Leader came to them and said that over 100 people searched the area and that no remains were discovered.

When I heard this part of Macaluso’s argument, I couldn’t help but wonder if they were relying on the information Joy Wray shared with LE when the body was found. If you look through the motion, you will find snippets of her interview there. In the report she wrote (which is also in the appendices of the motion), she claimed to have been a Team Leader.

After a lot more of the same arguments, Judge Strickland told Macaluso that he was arguing the merits of the case and needed to focus on relevance. The judge found that the information was relevant and wanted to know if he had the authority to certify a material witness from out of state. The judge essentially wanted to know what the defense wanted!

Macaluso said he wanted to depose Tim Miller in Texas and for the defense team to review the documents for themselves and not rely on someone else’s opinion of what was relevant to the case.

He also brought up a possible conflict of interest for Mark Nejame, since he was formerly the Anthony attorney. He stated that the Anthony family supports their daughter’s innocence and Mr. NeJame is now representing TES, which wants to keep the defense from finding exculpatory evidence!

I won’t go into the rest of his arguments, you can read them (if you want) in the motion. At this point, the hearing was at about 12 or 13 minutes!

Mark NeJame was next to speak to the motion. He explained again that the motion was overly broad. Rather than waste time, NeJame said that they had narrowed down the range of information to that which applied to the area where Caylee was found. The rest, he said, was not relevant.

He agreed that a searcher who found the body or other evidence would be expected to be questioned by LE and deposed. There would not have an expectation of privacy.

NeJame also indicated that, in identifying 32 people that he believed were relevant, they had limited the area to within 200 yards of the remains site. He also discussed the chilling effect on future searches if all 4000 searchers were covered by the subpoena.

Then, he offered to have the judge look over all other records and decide for himself. Brad Conway had also reviewed the records without permission to copy and had found fewer than 32 names which were relevant.

NeJame objected to a deposition in Texas due to lack of materiality. He did make an offer to have Tim Miller do a deposition in Florida as long as the scope was narrowed to the 32 people. He indicated that about 22 of these people had already been contacted and none of them had an objection. NeJame did say that the would all say that the area was indeed wet! They would also attest to the fact that the underbrush and vegetation were extremely dense.

Finally, NeJame pointed out that TES is a small, poor organization that would not have the funds to pay the expenses. As he has said before, he’d want a check to cover the expenses.

Andrea Lyon came up next and spoke.. Actually, more than a bit. She rejected the review of Conway and offered to go in to NeJames office to review the documents for themselves. She pointed out that the people making the decisions about what was relevant in the defense would not be aware of what the defense was looking for.

NeJame spoke briefly and stressed the issue of privacy for searchers who were never in the area.

At this point in the hearing, I’m starting to get tired of hearing about this issue! It is obvious to me that the defense is absolutely desperate to find ONE person to say they searched the exact area where Caylee was found and that it was dry and that there was no body. According to what Todd Macaluso stated earlier, it would be incontrovertible evidence that Casey Anthony was totally innocent!

The judge eventually stated that he would make a decision next week. I have a feeling that he will make a decision that closely resembles what they seemed to agree with, that the defense could review the documents and possibly identify other searchers at their own expense.

The next issue that came up was the motion to quash the subpoena filed by William R. Jay, Tony Lazarro’s attorney. This was a relatively simple discussion since other witnesses had set the precedent and that Baez had already limited the motion he had filed.

Jose Baez said that Tony Lazarro was noticed at the address on the witness list. He said he’d received a brief from Jay the at 4:00 PM previous day.

I was very impressed with Mr. Jay’s representation. Since it sounds like Tony is the next candidate to be subject to being shoved under the bus, he needs a good attorney!

Mr. Jay indicated that Tony had not been noticed and that he himself had only learned of the amended motion on Wednesday from a third party, which is why he had submitted his brief so late.

Jose Baez then made his main new point for obtaining calls from the end of September on was that Caylee’s remains were found December 11, 2008. He also assured the judge that he was not “in the business of throwing things out to the public” and that he found that “tacky, unprofessional, and unethical.” He also insinuated that the presser Tim Miller and Mark NeJame the day before was “tacky” as well.

My favorite statement from Judge Strickland here was... “tackiness not withstanding...”

Jay made a point that he didn’t want records from September released as the defense hadn’t established relevance. Judge Strickland acknowledged that the body had been found December 11 and felt that since the defense was indicating someone else placed the remains at the site after October 14, that time period was relevant.

In the end, the judge ruled that phone call records for June 1 - December 18 would be turned over within 30 days. If the cell tower pings are in the records, the defense could also have them. The judge ruled that text messages and internet were out for the time being. The judge will review the documents as to what information is material to the case.

If the cell tower pings are available, I’m sure the defense will put a great deal of time and effort attempting to track Tony to Suburban Drive within the appropriate time period!

The Motion For A Protective Order on Leonard Padilla, Rob Dick, Tracy McLaughlin, and Tony Padilla is addressed.

George Anthony takes the witness stand and swears to tell the truth.

Baez asked George how Leonard Padilla and his "employees" introduced to him. George stated that Baez introduced them to him as security staff. He then went on to tell their duties and responsibilities around the Anthony home. George indicated that they stayed out in front of their house, had Tracy McLaughlin inside the home and that others patrolled around the house and in the yard of the house behind theirs. Baez asked George how the various people communicated with each other. Nothing much was established there except that he saw Rob Dick with a potable radio or walkie-talkie at one time. He also elicited that the mobile home parked out front was the command center.

George also indicated that Padilla and his people transported Casey to and from her home confinement officer and to Baez’s office. He stated that he and his family felt safe with the security provided. They had no concerns for Casey’s safety as there were always 4 or 5 people around her all the time. Baez also brought up the protesters who were in front of the house. George pointed out that they were frequently threatened.

Baez also testified for his witness by stating that this was a publicity stunt for Padilla and that he felt it was an “necessary evil.” George agreed.

Linda Drane-Burdick then cross-examined George. At this point, I remember thinking that George was gearing up for another “deposition” act. He picked apart words and tried to avoid giving definitive answers.

In the matter of security, Drane-Burdick elicited from him that Padilla contacted him through Baez. When asked if he was aware that Padilla was there to help find Caylee, he answered that Padilla may have “taken it to that level,” but, as far as he was concerned, Padilla and his crew were simply there for security.

George also claimed that he couldn't remember that it was Leonard Padilla who personally posted the $50,000 cash to bond Casey out of jail. He said he thought it was Tony Padilla who did so. (I’m not buying George’s poor memory at this point!)

George waffled a bit more when Drane-Burdick asked if he met the Padilla group at a warehouse on Orange Blossom Trail. He answered "no." After a bit more questioning, he then described the location where they met as an office complex on Orange Blossom Trail! Baez was not there.
When asked if this meeting occurred several days before Casey's release from custody, George said he was not sure.

George was also vague on his recollection that the main purpose of the security was that Padilla and his people were there to secure their asset, Casey Anthony. George grudgingly admited that was true, but that they were mainly there to protect the entire family.

When asked if any of these security people provided legal services, George asked for a clarification. He then went on to say that they were there for security only, “protecting us and our daughter.”

Drane-Burdick went on the ask if he was in the security business as a security officer. George said he wasn’t “at the moment.” She went on to ask if he could have gotten friends in the business to help. George answered, Yes, he could have if he "would have put out the effort."

George then went back on a “deposition rant” when asked about a friend of his from Ohio, Jim (what’s the relevancy?) Campbell. Judge Strickland quickly put him in his place and had him give the man’s last name. George pointed out that Campbell arrived in Orlando after the security people provided by Padilla were in the house.

As Drane-Burdick was asking a question about the arrangements with regards to the rules set by Baez about conversations with Casey, George started to talk over her. Again, Judge Strickland reigned him in and allowed the prosecutor to finish her question. ( I’m glad the judge is trying to educate Mr. Anthony on proper conduct in a court of law!)

It was finally established that the rules were that the Padilla team members were not to talk with Casey about Caylee unless Jose Baez was present for the conversation. If Baez was not present, a member of the family had to be there. It was also brought out that George was unaware of the privacy agreement or the terms it contained.

The next topic Drane-Burdick brought up was whether or not the members of their family were working at the time. George stated that he worked sometimes, but that Cindy and Lee took leaves-of-absence from work and therefore a member of the family was always in the home during that particular time out on bond.

She also asked if Cindy or Lee could have transported Casey to her attorney’s office. He mentioned that Lee took her once and that the “security” crew followed them. The family members were always available to take Casey on her out of home-confinement jaunts .

Drane-Burdick then asked if he or Cindy was present in the home when Tracy spoke to Casey. He said that they were and that Lee was in and out of the home during that time. She asked if he could hear those conversations if he so chose. George stated that he didn’t because he didn’t want to eavesdrop. He stated he wouldn’t follow them around to listen.

Hey, wait! Didn’t George just say he was aware of the rule that Tracy couldn’t talk to Casey without Baez or a family member present? George even says he can’t remember if they were ever behind closed doors!

My notes have the following at this point:

DOESN'T GEORGE REALIZE HE JUST SANK THE ARGUMENTS? HE AND THE FAMILY WERE THERE TO FOLLOW THROUGH WITH MONITORING COMMUNICATIONS AND THEY DIDN'T!

That was the end of George’s testimony and Drane-Burdick indicated to the judge that she has CD’s with police interviews of Leonard Padilla, Tracy McLaughlin, and Rob Dick which she would like the judge to listen to. (This is the information we have all been waiting to get!) Jose Baez objected to this as not being relevant since the prosecutor didn’t call them as witnesses. Drane-Burdick argued that the interviews are relevant and that Jose Baez had presented an argument here in court that is not in line with the information he presented in this motion. His motion was far more expansive in content.

She then continued on to indicate that heresay is admissible in a hearing and it was not necessary to fly the witnesses in from wherever they were. The judge indicated that he would listen to them and give them the weight he chose.

Drane-Burdick then began dropping the bombshell of the day. She indicated that Baez had presented copies of documents in his pleading and had not produced the originals. She was referring to the privacy agreement signed by Baez and the Padilla crew. She indicated that there had been no testimony presented at the hearing about them. She wanted to see the originals before deciding to object to them at the hearing. Baez says he didn't have the originals with him but could provide them to the court and to the State. He stated that HE could represent them as “a true and accurate copy” in the same way Ms. Drane-Burdick represented the nature of the interviews she had submitted.

The judge said that Drane-Burdick can review the originals Baez would provide since he had to listen to the interviews before ruling on the motion.

Strickland then asked Baez to state his argument for privilege. Baez indicated that when approached by Padilla asking if he would mind if he bonded Casey out, he stated that “anyone in their right mind” would say no to the offer.

Drane-Burdick objected to Baez testifying to this matter. She wanted proof of the facts that he was stating.

The judge asked her to follow up in rebuttal.

Baez stated that after meeting Padilla, he decided he needed some sort of agreement due to the unusual circumstance. He said it was difficult to anticipate what the group would do or what would happen in the future. He claimed he searched the entire law library to find some document that would apply. It’s at this point, he referred to Padilla as a “flamboyant cowboy.” He stated that if there were any confusion about the agreement, everything would lean in favor of Casey’s constitutional rights. Therefore, the privacy agreement created confidentiality.

At this point, Judge Strickland asked if this was a situation where Padilla and crew rendered legal services. Baez argued that they did. He said that he felt responsible to provide round-the-clock security for Casey. He stated that, as they served in that security role, Casey felt comfortable to speak freely before them and THAT was part of the legal services.

OK, gang, I’m not getting this. What we read in the agreement provided by Baez and testified to by George Anthony was that the Padilla crew members were NOT to speak about the case with Casey UNLESS either Baez or a family member was present. Casey was smart enough not to talk about the case with LE after she lawyered up, yet she felt free to talk in front of security people? Add in the fact that the security people were there to protect their “asset,” and we have a simple situation where Casey just blabbered on to Rob Dick about the abduction at Blanchard Park! Perhaps she was out to gain his sympathy?

The judge interrupted Baez’s argument to say that Ms. Drane will argue, “You get your flamboyant cowboys as you find them” and to explain the situation to him.

Baez responded by comparing “security” to a “rogue paralegal.” I didn’t quite get the meaning, since security people don’t necessarily have any legal training!

Moving on, this article is getting way too long!

The judge stated that he’d never seen a motion like this before.

At this point the judge got into a discussion with Baez as to why HE is bound by the agreement which is between Baez and Padilla & Co. I didn’t follow all of this and I’ll move on.

What was most interesting in this exchange was that the judge felt that Baez was treating the situation as a Fourth Amendment violation rather than a civil situation. He pointed out, using the same phrase I used in my last entry, that “the horse had already been let out of the barn,” that Leonard Padilla had spoken frequently in the media about the case. Baez’s response was that he had been too busy to deal with it and would take it up at a later date in civil court!

HELLO? Baez had every opportunity to slap a gag order on Leonard Padilla a year ago! Meanwhile, a great deal of what he learned and what his people learned has been around for a long, long time!

I truly believe that the entire problem here is that Baez is suffering from some very bad decisions he made at the get-go in this case. This situation is of his own making, owing to his inexperience at handling complex cases such as this.

I noticed Ashton was widely grinning and raising his eyebrows at this point. I suppose he thinks as do on this matter. I do hope that he works on his demeanor when there is a jury present.

Linda Drane-Burdick then argued the fact that while notice of the motion was sent to and address in California purported to be that of Leonard Padilla, none of the others were legally noticed. Apparently, the media was not noticed either. She also pointed out that this isn’t the first time there has been lack of notice.

She also pointed out that case law states that only those statements made in the rendition of legal services are privileged. Baez’s motion does not lay out which statements are subject to the privilege, IF Baez’s agreement gave the “security” people privilege.

She then continued by pointing out the alleged oral agreement mentioned in the motion. The motion does not even make clear if the oral agreement was made with Baez or some other member of his firm. There was no testimony at the hearing from any witnesses concerning this alleged agreement. The defense had not established proof that this agreement ever took place. Even if it did exist, it would not prove anything more than a business arrangement, certainly not an agreement to provide legal services. She further indicated that the oral agreement, if it existed, came before any written agreement. Leonard and Tony Padilla were not going to post and assure the bond unless they could monitor Casey and protect their investment, since the risk was so great. Once Casey was released on bond, Baez changed all the rules. He said only Tracy could stay in the house. She pointed out that as far as civil actions were concerned, Baez had breached his own agreement!

Drane-Burdick then dropped the rest of the bombshell. Apparently, Tony Padilla had stated that the agreement in the motion was not the same agreement he signed. She said that Tony Padilla had informed her that he had signed a separate document. He also told her that he had asked for, but not received a copy of the document he signed. He wanted to make it clear that, in the document he signed, he was a separate entity from his relative, Leonard Padilla and the others. She also pointed out that the other three were not one business entity either.

Drane-Burdick pointed out to the judge that he must go by the "four corners of the document" and that one cannot contract for privilege. The contract even stated that there was no relationship between Baez and the others. She mentioned a great deal about the situation and said that Baez had told Casey not to talk about the case with them! In addition, as was said before, there were always people in the house around Casey who could hear the conversations and the presence of a third party negated privilege.

In his final rebuttal, Baez continued to try and fight his way out of a wet paper bag again by asserting that there was privilege. He seemed to take great umbrage at being accused of “manufacturing false evidence” and being asked to provide original documents. The judge quashed any further comments about this by stating that all Baez had to do was show her the originals and it would all be over!

Finally, Baez admitted that not all of what Casey said to the security guards could be considered privileged information and would be subject to testimony. He also stated that he was not responsible to notice the media every time he wanted to assert attorney-client privilege and that all parties (Padilla & Co.) were noticed for the hearing. He stated that Drane-Burdick had “shot herself in the foot” by not authenticating the audio interview through a witness. He even indicated to Judge Strickland that he was in essence saying that he would say that he believed everything the State said, but not what he, Jose Baez said.

I do believe that he is still smarting from being asked to produce the original documents!

Again, the judge will consider the motion and not rule today!

We finally got to the Motion to Set A Trial Date. This discussion was more cut-and dried than the previous one. In brief, State’s Attorney Frank George stated he wanted to schedule a speedy trial because:

The State is ready to proceed with the trial.

The time frame of the trial is brief, July 8-July 15 (2008). While there are overlapping witnesses, the testimony will be such that it wouldn’t involve the murder case.

Mr. George stated that the defense has two reasons to postpone the trial: 1) they are too busy and 2) they won’t be able to get a jury.

There is only one attorney of record of case for the trial, Jose Baez. The motion Baez filed stated that Andrea Lyon would also deal with the case. So far, there has been no motion filed to do so.

They are all busy, he has 80 other cases he is involved in. Jose Baez has 20 other cases he is involved with, most of them new cases taken on since the state reinstated the death penalty.

Gee, I wonder if Casey knew this?

My favorite quotes from Mr. George were that, “Mr. Baez isn’t living and breathing the Casey Anthony murder case 24/7" and, “Ms. Lyon hasn’t quit her day job, either!”

They can give this case a day of their time.

Amy Huizenga has filed an affidavit that states she wants to get this case over with because it’s causing her stress and embarrassment. She has had difficulty finding a job because of this.

This would be a one day trial with 15 witnesses at most, not including jury selection.

While getting a jury is a problem, they can try. Why not have a bench trial?

Even though she has no standing in this case, the Court allows Andrea Lyon to speak to the motion.

Since this article is getting very long, I will spare you the details of all she said. She basically blamed the state for the delay, as was stated in the motion. She spent a great deal of time explaining how the enormous amount of work that needs to be done to save Casey Anthony from the death penalty.

Mr. George rebutted briefly and the major point he made was that the case should be placed on the docket. He added that if Casey's current attorney's were too busy to handle this case, she should have further counsel.

Again, the judge will make a decision next week.

Casey Anthony: Another Hearing Coming, Part 2

Leonard Padilla and his people got involved in the case against Casey Anthony back in August, 2008 when he arranged to bail Casey out with the intention of assisting her in locating her daughter, Caylee.

According to the Baez/Lyon Motion For Protective Order To Bar Privileged Testimony Of Mr. Leonard Padilla, Mr. Tony Padilla, Ms. Tracy McLaughlin, and Mr. Robert Dick, Padilla's involvement began August 19 when Tony Padilla provided the surety and posted the $50,000 for the bond. The money was provided by Leonard Padilla and Casey was not responsible for repaying the money. Casey was released on that bond on August 21.

In addition, there was a verbal agreement that Padilla, McLaughlin, and Dick as well as others would provide security for Casey with no charge to the defense. It was agreed that McLaughlin would stay with Casey in the house at all times.

Casey's freedom at that time lasted all of eight days. On August 29, Casey was arrested on the bank fraud charges and Padilla revoked the bond.

Working strictly from memory here, I can remember the circus the case became at this point. Casey was home, Padilla & Co. were parked out front of the Anthony house in a camper. Casey was seen being driven to day-long sessions with Jose Baez, driven and escorted by Rob Dick. Protesters lined the sidewalks and the media trucks sent out a constant stream of reportage from the Hopespring Drive home.

Leonard Padilla became a media figure, frequently commenting on Nancy Grace about the case. He regularly fed little tidbits from his tenure as head of security and the details kept us riveted to the screen. He broke the Blanchard Park scenario, told us about confrontations that took place inside the Anthony home, and even sponsored the infamous search of the Little Econ River.

Love him or hate him, Leonard knows a lot about the Anthony family. So does Rob Dick and Tracy.

Now, the defense is attempting to have them muted.

According to the motion,

... the Defendant, CASEY MARIE ANTHONY, respectfully requests that this Court grant her application and preclude the following:

1) Leonard Padilla, Tony Padilla, Tracy McLaughlin, and Robert Dick from making statements to the prosecution regarding any statements made by Miss Anthony regarding the disappearance of Caylee Marie Anthony, the investigation of the disappearance of Caylee Marie Anthony, or any litigation arising out of the disappearance of Caylee Marie Anthony.

Casey talked a great deal during those days she was free. Nobody questioned her about the case and they were just listening to her. I'm sure Jose Baez must have told her not to talk about the case with them. Now, Baez doesn't want them to give depositions in both the criminal and civil cases.

2) Leonard Padilla, Tony Padilla, Tracy McLaughlin, and Robert Dick from serving as witnesses for the prosecution if any testimony will pertain to statements made by Miss Anthony regarding the disappearance of Caylee Marie Anthony, the investigation of the disappearance of Caylee Marie Anthony, or any litigation arising out of the disappearance of Caylee Marie Anthony.

Notice, it doesn't say "conversations" with Ms. Anthony!

My favorite section of the motion is this one:

3) The release of any statements to the media that were made by Leonard Padilla, Tony Padilla, Tracy McLaughlin, and Robert Dick to the prosecution as it pertains to statements made by Miss Anthony...

This horse left the barn a year ago!

It is obvious why the defense wants to muzzle these folks. They have a rare view of Casey in her home. She babbled on and on when she should have kept her mouth shut. We all know about her demeanor. The defense certainly doesn't want the jury to know what they know.

The question is HOW the defense feels they can stop them from talking and testifying. They claim attorney-client privilege. They also claim that the privacy agreement they signed precludes their doing so and provided a brief in support of that fact and a copy of the privacy agreement.

From the brief:

The statements made by Miss Anthony to Leonard Padilla, Tony Padilla, Tracy McLaughlin and Robert Dick are covered by the attorney-client privilege because these individuals were acting as agents of Miss Anthony's defense counsel. (p. 2)

The brief goes on to give numerous legal decisions concerning attorney-client privilege. My favorite citation is this one:

...The privilege applies even if statements made by the client are made to the attorney's agent and not directly to the attorney.Delap v. State, 440 So.2d 1242, 1246-47 (Fla. 1983). For example, in Delap, statements made by the client to investigators and detectives utilized by defense counsel were covered by the privilege... (pp. 3-4)

Well, that citation would certainly pertain to Dominic Casey while in Baez's "employ," but I wonder if they can sell the idea that security agents are in the same situation.

Here is a quote from a WESH article from July 17 which pretty much sums up what we may hear from the State's Attorney at the hearing:

Defense lawyer Richard Hornsby said the agreements are worthless because Florida statutes do not allow attorneys and bail bondsmen to enter in to those types of confidentiality arrangements.

"Jose Baez should have never had a reasonable expectation that anything she said would be confidential or fall under the attorney client privilege and that's a big problem," Hornsby said. "He should have advised her right away -- don't say anything to anybody."

The article goes on to say:

While his employees were in close contact with Casey, Padilla has said she made some potentially damaging statements. While she was out of jail and Caylee was still missing, Anthony allegedly blurted out, "They haven't even found the clothes she was wearing." In November, Padilla confirmed the statement.

"Everything's been a game to her...to lead us to believe the clothing was somewhere but not in the proximity of the body," Padilla said.

For more than a week, Padilla's employee Tracy McLaughlin essentially babysat Anthony in the Anthony home. Padilla's employees routinely drove her to and from Baez's office. Padilla said Anthony was plenty chatty.

"She would drop little statements when she was being driven back when she was with Tracy," Padilla said.

What else Anthony may have told McLaughlin and other employees remains a mystery. McLaughlin to this point has maintained a very low profile and turned multiple down interview requests.

The article went on to explain that this motion probably came about because the transcripts of Leonard Padilla and his group were due to be released in a document dump.

Will the motion succeed? Mr Hornsby doesn't, based on Florida Laws. Robin Sax, a prosecution attorney said on Nancy Grace on July 20 that:

I think that this is frivolous waste of time and I don`t think that the attorney/client privilege is going to hold where there`s no attorney/client relationship.

On the same program, Doug Burns, a defense attorney stated:

...But the minute Leonard Padilla got involved in this case, I said to myself, 20 red flags of attorney/client privilege went off of my head and I knew it wasn`t going to be privileged...Definitely going to lose that motion and he`s going to lose that motion and he`s going to testify.

Burns also pointed out that subpoenas tend to take precedence over privacy agreements.

I am so looking forward to the arguments about this issue in court Friday!

I am also looking forward to the release of those transcripts!

George and Cindy Anthony: Beyond Denial

Those who have followed the disappearance and murder of Caylee Anthony have been forced to focus attention on the slain toddler’s grandparents. At first, most people thought they were in denial. They couldn't believe that their daughter may have murdered their granddaughter. Both Cindy and George obviously loved Caylee very much. They also love their daughter, Casey, although reports from family and friends point to difficult relationships within the family.

In my coverage of the case, I have tried to refrain from comment about their unusual behavior. I chalked it up to denial, deep denial as did many. I allowed that, in their overwhelming grief, they were lashing out in all directions. I made it my focus to report on the legal proceedings which, at the present time, seem to be leading to a murder trial for Caylee’s mother, Casey.

In this labyrinth of a case, we have had a lot of distractions from this central focus. We’ve had the "Todd Black" distractions. We have had Casey’s lawyer, Jose Baez, investigated for possible shady dealings in the entertainment field to fund the defense. Private investigators Dominic Casey and James Hoover investigated the site of Caylee’s remains, supposedly led there by a psychic whose "dream" led them there. There is the meter reader, Roy Kronk. There has been talk of a "dream team" of lawyers and expert witnesses who have flocked to defend the alleged murderer. There is the undercover sting by ex-boyfriend Tony Lazzaro to ferret out information from Casey’s brother Lee. In the past week, we have seen the judge on the case and private investigator Dominic Casey file charges against Baez with the Florida Bar. It’s been a three-ring circus with an extensive side-show thrown in.

Most of all, we have had George and Cindy Anthony.

From the very beginning, Cindy Anthony took the offensive and blasted the media, law enforcement, and the public at large for not doing whatever she deemed necessary to find her granddaughter. Almost immediately, Cindy started to shovel blame for Caylee’s disappearance on Casey’s friends, most noticeably Jesse Grund, Ricardo Morales, and Amy Huizenga. She appeared everywhere on the media to plead for people to search for a living Caylee and at the same time put every roadblock she could on the efforts of TES to search for her granddaughter.

At first, George Anthony stayed in the background and allowed Cindy to rant and rave. As time went by, his temper flared and we caught sight of his tantrums. I clearly understand that he has been anguished about having to testify against his daughter to the grand jury.

However, in many ways, the Anthony’s have only themselves to blame for a good deal of the negative attention they have garnered. While they were begging the press to publicize the picture of there missing grandchild, they were antagonizing everyone at the same time. By denying the possibility Caylee might be dead, they were denying searchers the opportunity to find her remains in a respectful manner. They avoided the possibility that their own daughter could possibly be responsible. At one point, Cindy exclaimed that her daughter, when it was all over, would be called the "Mother of the Year."

Here are a few video links which demonstrate the manner in which George and Cindy dealt with the media and the public to push their agenda forward:

Cindy on Geraldo, July 19
Fox Interview with Cindy, July 21
Cindy on Greta, July 21, 2008
George’s Stinky Pizza Recipe, about August 3, 2008 (after seeing Casey in jail)
Cindy Anthony lashes out at the press, August 29

Indeed, they were under tremendous stress. Casey was home on bond that was posted by Leonard Padilla and they were constantly confronted by protesters in front of their property. However, instead of staying inside and allowing the police to handle disturbances, they still felt that they had to personally confront those people.

Once Casey was returned to jail on October 14, without bond on murder charges, the protesters left and George and Cindy were afforded a blessed peace and quiet at their home. However, they did not did not stop their continuing efforts to paint their daughter in a positive light and cast aspersions on those they attempted to blame for the crime. Every time there was a release of documents under the very liberal Florida Sunshine Law, it seemed there was another "sighting" of a live Caylee somewhere in the country. Most famous is the picture in an Orlando Mall of a little girl playing in a children’s area. In December, George and Cindy made a trip to California, ostensibly to personally check on a live-Caylee sighting tip. While they were there, they decided to plead their case on Larry King Live.

Here is a link to the first part which will lead you to the remainder if you have a desire to watch the entire program: Part 1

Caylee Marie Anthony’s remains were discovered the next morning, December 11, 2008. Nothing much was heard of from the family until George’s "suicide attempt" on January 23, 2009. He was hospitalized and eventually released for follow-up care near his home in Orlando.

Fast-forward to Thursday, April 9, 2009. After having delayed the depositions in the suit and counter-suit for defamation between Zenaida Gonzales due to George’s fragile emotional state and the fact that George and Cindy were seriously grieving the loss of their granddaughter, the couple appeared for depositions at the Morgan&Morgan law firm, accompanied by their attorney, Bradley Conway.

What followed will go down in legend as examples of how not to behave at a deposition. George Anthony, emotionally fragile, was ready to do battle with attorney Keith Mitnik. He argued, refused to answer key questions, and accused Mr. Mitnik of "flipping the bird" at him whilst pushing his glasses up on his nose. He too terrible offense at the term "remains" being used to describe the scattered bones of his granddaughter. Personally, I have used the term "remains" frequently in my posts. One can’t say "body," nor would one want to say "carcass," indicating bones. Unfortunately, "remains" is the most civilized way to describe what was left of little Caylee after the ravages of months in the Florida heat and torrential rains which flooded the area where she was found. One positive aspect of George’s testimony was that he totally abandoned the "stinky pizza" defense and repeated the facts as he told them to LE. He admitted it was the odor of death in the trunk of his daughter’s car.

Cindy behaved just as badly, if not worse. She chomped on her gum throughout the deposition and flounced around in her chair as she disparaged and insulted the attorney questioning her. She was so totally uncivilized and rude that, just watching the video, I am amazed how well the attorneys kept their wits about them and attempted to treat her with more kindness than she deserved.

At this point, both George and Cindy need a great deal of help. They have moved way beyond denial. They are out to prove someone else's son or daughter has done what they refuse to believe their own child has done. They are playing verbal games and positioning their testimony somewhere between fact and outright perjury. Most of all, they are trying to help Casey.

The best way that George and Cindy Anthony can help their daughter is to get some serious counseling and listen to the professional lawyer who has volunteered his time to help them through the ordeal. There is no way that I can believe Bradley Conway advised his clients to behave the way they did at the depositions. What they did there was exactly the opposite of helping their daughter. Instead, they left the impression that they had things to hide. By refusing to answer with a quick yes or no or giving short, succinct answers to questions, they drew attention to their outlandishness. By attacking the Morgan&Morgan attorneys and by acting in a smug, demeaning, and childish manner, they showed a contempt for this legal process. If they take the stand in the trial and attempt the same kind of behavior, they will not impress any jury as "grieving grandparents." Instead, they will be seen as contemptuous of the law. This will also not help Casey. If Casey Anthony is innocent, as she claims, the truth, and only the truth, will gain her an acquittal.

The Case Against Casey Anthony: Evidence, Transcripts, and Video

Update!

Today, the court released tape recordings of the Dominic Casey interview.

Part 1 Part 2 Part 3

Ever since the discovery of Caylee's remains on Suburban Drive, I've thought of this case as a triangle. The Orlando County Sheriff's Office and the FBI have been continuing the investigation and tying together the three main crime scenes. The three parts of the triangle are the Anthony home, Casey's Sunbird, and the overgrown area where Caylee was found.

The most recent documents released to the public have helped to tie it all together. We've known for a long time that it is likely Caylee's body was placed in the back yard. From there, evidence of decomposition in the trunk of the Sunbird shows that Caylee was there after her death. Items from the home were also there at some point. These items were found at the crime scene along with Caylee's skeletal remains.

There is still a lot of this evidence that needs to be tested. The heart-shaped stickers need to be analyzed to see if they are the same ones that were found in the woods. The tags on the clothing and laundry hamper need to be researched and compared to those seized from the Anthony home. The plastic bags also need to be compared to the ones in the home as well.

In addition, we have yet to hear about botanical and entomological studies on the plant life and insects. There has been no release about the contents of the vacuum cleaners and carpet cleaners. There are no reports about fibers or hair found on the duct tape. There is so much more that has not been made public.

The FBI reports indicated that trace evidence testing was ongoing. We will hopefully find out more as time passes.

Meanwhile, the defense team is attacking the evidence. They insist that the diary entry from June 21 was written in 2003. Let's hope that some form of forensic ink testing will tell otherwise. In addition, in a press release by Baez's new spokeswoman, Marti Mackenzie released a statement.

The State’s forensic report on duct tape, plastic bags and other items is a one-sided law enforcement-generated report and is biased and speculative. It uses ‘junk science,’ the kind of flawed comparative analysis that the two-year study by National Academy of Sciences released today.

We've been hearing the term "junk science" from the defense team for a while now and this is a good indication of their strategy for the trial. We should all start preparing ourselves for the sight of their world-renowned scientists getting up on the stand to explain why their own work can be qualified as "junk"! It does seem ironic, though, that they won't try to debunk the DNA testing done to identify the remains.

In spite of the defense's desire to jump on the "junk science" band wagon, more and more evidence has come to light in this last document dump. There are no "bombshell" results in any of those pages. There are, however, snippets of information about the family that help to develop a better understanding of the dysfunctional situation into which Caylee was born.

Dominic Casey Transcript Released

Today, we were all treated to an 80-page transcript of an interview Dominic Casey gave to the police and FBI on January 7.

It is a remarkable document in which Casey, accompanied by attorney Brad Conway answers questions from Sergeant John Allen and Special Agent Nick Savage of the FBI.

He starts by stating he went out to the Suburban Drive on his way to the Meet and Greet to check out a tip from KioMarie Cruz, who had mentioned in a statement last July that she and Casey used to hang out in the woods behind the school. However, before he could do that, he received a call from a psychic who told him to search an area at the end of Hopesprings Drive for Caylee's remains. She told him he would find them by three paving stones. Oh, and he invited his buddy James Hoover to come along since the Anthony's had invited him to the Meet and Greet as well.

He claimed he didn't know Hoover was videotaping his search until he happened to see Hoover with a camera. When the psychic told him to go to a certain house to search a culvert, he ended up digging in the soil near the house. He claimed he didn't know Hoover was doing that either.

Another aspect of this interview is an attempt by Allen and Savage to pinpoint when he worked for Baez, Casey Anthony, and George and Cindy Anthony. He first said he was contracted to work for the Anthony's on July 29. Then he changed his mind and said he worked for Baez starting that date. He apparently signed on to work for Casey Anthony separately on September 12 and is still under contract with her. His only problem is, Baez hasn't allowed him access to Ms. Anthony since October 12. We never do learn when he began working for George and Cindy.

There is much more, it's a pretty good read if you have the time. Judge Strickland is at present reviewing Casey's second interview to see if it contains privileged information. I'm looking forward to seeing what happened in that one. One thing I'd like to know is if Casey is ever informed that Cindy Anthony told LE when they were conducting the second search of the house that she had had her people out at the site!

Casey Caught on Tape

Thanks to my friend Kitty Malone for alerting me to the fact that Casey was surreptitiously taped while watching the news on a television in the nursing unit when the discovery of the remains was being broadcast.

Anthony doubled over twice and appeared to hyperventilate, according to the source who has seen the tape.

I don't know if this particular video will be aired to the public or to a jury, but it gives me new respect for the OCSO. When Casey had been caught watching coverage of Leonard Padilla's search of the Econ river, it was reported that she was asked to return to her cell. She got up calmly and didn't seem to respond to the report that "something" had been found.

This time, she hyperventilates and asks for medicine to calm her down. Remember, at that particular point, there had been no positive identification of the remains. Consciousness of guilt, anyone?

Watching the news today, it seems we just may be having another set of documents released soon. Let's hope that the evidence revealed in them will continue tie together the triangle of this crime.

Catching up on the case against Casey Anthony

COMMENTARY

I've been gone for a while, but I've been closely following the case against Casey Anthony. With Caylee's positive identification by the medical examiner, I was hoping that the circus surrounding this case would end and that the serious business of court procedure would flow more smoothly.

That did happen for a short time. The defense wasn't allowed to "assist" the CSI team and the FBI in the painstaking sifting of soil at the scene. Henry Lee was limited to the view he could get from his camera, behind the yellow tape. I wasn't surprised that the defense then turned around and ignored that piece of land where little Caylee's remains were found. They knew there was nothing more to find.

Now, Caylee's tiny bones rest in a funeral home, waiting for Dr. Werner Spitz to examine them on his own. Since Jose Baez requested the documentation from the "autopsy" conducted by Orlando County Medical Examiner, Dr. Jan Garavaglia, little Caylee's funeral has had to be put on indefinite hold.

Today, the news about the case has focused on those remains. According to WESH,

The discs include X-rays and photos of her body, which were supposed to be delivered to the defense under a court's order. But in a new motion, the Orange-Osceola State Attorney's Office said it has concerns that the images will be reproduced and sold, according to WESH 2 reporter Bob Kealing.

In this motion, the state argues that substantial licensing fees have been paid for pictures and video of Caylee taken while she was alive. That is why prosecutors want the judge to place special restrictions on digitized images of the remains before they hand them over to attorney Jose Baez and his defense team.

In court documents prosecutors say they have three discs ready to hand over, but they want the judge to order Baez not to reproduce those images in any way. They also want restrictions placed on whom Baez can show the images.

I don't know if the prosecution will prevail in this instance, but the motion does bring up a number of questions that have never been answered about the proceeds from the licensing of those pictures and videos. Who did receive all the money?

The Baez Law Firm also got a verbal spanking from civil judge Jose Rodriguez. From WFTV

Casey Anthony's defense team wanted to avoid having her testify in connection with the civil trial, which could then be used against her in her criminal trial. Baez had hoped the deposition could be delayed until after the criminal trial.

During Tuesday morning's brief meeting, the judge refused to hear the request and scolded Jose Baez's team for personal attacks against Morgan and Morgan, the law firm representing Gonzalez, and said Baez was taking the profession to a new low.

The judge told Baez to stick to the law and said that the request for a hearing didn't follow proper protocol and that there was not enough notice given to make such a request.

Apparently, Jose Baez and his attorneys haven't learned proper procedure for filing motions despite assistance provided them by Judge Stan Strickland last year! I hope they all get on a learning curve about basic court procedures.

As far as the verbal spanking that the Baez Law Firm received, perhaps they also need to learn that it's not nice to snipe at the opposition in the actual counter suit. Paragraph 7 of the suit states:

The Plaintiff and her attorneys knew this when they filed said lawsuit yet went through with this frivolous lawsuit so as to generate publicity and press for their law firm. A law firm, it should be noted, which utilizes highway billboards in order to advertise their services. This lawsuit allows them to generate further publicity for their law firm without paying thousands of dollars for a billboard.

Somehow, I'm not quite following that legal argument! Indeed, I'm thinking just WHO here is benefitting from the publicity in this case the most.

As I recall, the whole issue in this situation is that after Morgan filed the case on Zenaida Gonzalez' behalf, The Baez Law Firm filed a counter suit. According to Morgan, that left Casey Anthony open to deposition in support of her counter suit. From what I understand, Casey's taking the 5th to questions asked of her would cause her to lose her suit. It's a very bizarre situation!

There will be a hearing on the matter this Thursday, January 8.

Meanwhile, things have been pretty quiet on the Anthony Family Front. That's probably because they are all now listening to their lawyers for a change. Oh, and their all waiting for full immunity before interacting with Law Enforcement again.

It does seem like the circus is starting up again. I haven't even begun to mention the ways. The Meter Reader, the Psychic, Leonard Padilla, etc., etc., etc.!

The Case Against Casey Anthony: Pre-Trial Hearing Tomorrow

Just a reminder that tomorrow is the long-awaited day for the pretrial hearing for Casey Anthony. InSession on TruTV will broadcast it live with Beth Karas doing the coverage. It should also be live-streamed by CNN and local stations. It will be interesting to see what happens!

If I am able, I will post a summary.

Mid-Week Summary

This week has been a virtual tornado of Baez and Anthony spin. Sunday evening, the Anthony family announced a temporary cessation of vigils for Caylee until the New Year.

At the same time, Cindy opined about the decision of the prosecution not to seek the death penalty:

"I don't think they have much of a case at all," said Cindy following a candlelight vigil for Caylee at the Eastside Baptist Church in Orlando. "I don't think they have a death penalty case at all, so I wasn't surprised."

She added that the whole notion of raising a death penalty case against her daughter was ridiculous. "I think we should be out there looking for Caylee and not focused on a few lies Casey told to the Sheriff's Office. The evidence will speak for itself."

It's interesting that Cindy refers to her daughter's "few lies" when those following the case know that virtually everything Casey said was a lie!

Monday morning, Jose Baez appeared on the Today Show. The broadcast began with the coverage of the extensive pretrial publicity and the difficulty of finding an impartial jury. Apparently, asking for a change of venue would cause a delay in the trial, something the defense does not seem to want. Baez still is doing media research to make a decision on the change of venue issue.

In his interview, Jose Baez contended that

"We believe that Caylee is alive, and what we want to do, as her attorney I have a responsibility to Casey, and that is to do the best job possible, so it's not an issue of rushing to get a trial just because we expect a body to be found,"

Apparently, he believes a speedy trial is necessary to absolve Casey of guilt and get her out of jail as soon as possible. I also noticed that Mr. Baez is now using the royal "we" nowadays.

Baez also indicated that he believes the "leaks" from law enforcement were put out in the public well before they should have been. He also stated the jailhouse videos released last week show an emotional Casey who is crying all the time. Cindy Anthony had also applauded the release of the tapes saying that:

"I said from the very beginning, if they would have shown those tapes people would have seen that she does have emotions," Cindy Anthony said. "She's not a cold, calloused person like everybody wants to paint her out to be. She's a desperate, loving mother."

Did Cindy actually view the videos, or is she doing this from memory? I haven't heard ONE expert say that's how Casey came off in those tapes. Pathological liar, deceptive body language, severe family dysfunction: That's what I observed and what was reported in the news by any number of experts.

Baez also claimed the public only has a "fraction" of the story. My goodness! All the thousands of pages of information released under the Florida Sunshine Laws are only a fraction! Does that mean Casey has much more to say? If she does, she'll have to take the stand at the trial. According to the defense witness list, there are only three scientific experts listed. There don't seem to be any witnesses to buttress Casey's lies and swear to her veracity.

Also on Monday, Jose Baez petitioned the court for an Application For Subpoena Duces Tecum for the release of various security tapes, including those from the infamous "Caylee sighting" at the Florida Mall. Apparently, the Anthony family can't get them for themselves without one. According to George Anthony, there is a 50-50 chance the little girl is Caylee.

Hello? How did he come up with that? OK, I get it, it's Caylee or it isn't! I suppose that the same logic would apply to almost any little brown-haired girl with bangs and a pony-tail? If there is a math wizard out there anywhere, please explain George's math to me!

The last news reported Monday of any value was the fact that Jose Baez still hasn't picked up the DVD's with the rest of the tips he's been begging for. According to WFTV:

Baez's spokesman said the sheriff's office has misled them in the past, implying the abandoned discs don't contain tips of Caylee sightings. He said that despite the defense having not looked at them yet. He also said that Baez "could maybe already know what's on those discs."

I personally believe he knows they won't find anything of value on them and he doesn't want to pony up the money he already owes the court for the last batch of tips. Also, his staff of 40 that he alluded to at the hearing last week just doesn't want to go down to the courthouse to sort them out for free.

Tuesday's news was replete with announcements about Cindy and George's journey to California on Wednesday to appear live on the Larry King Show. Of course, that trip is secondary to another hunt for Caylee. This time, they plan to visit a restaurant in Newport Beach where there was yet another Caylee "sighting."

On Nancy Grace, Leonard Padilla chimed in with yet another of his opinions:

Everybody knows when she died, and the 30 days is not a secret anymore ... Don't be surprised if Orange County or the FBI don't drop it on us here that they've got the body somewhere," Padilla said.

So, folks, it seems as though tonight is the night for the Larry King interview. It will be interesting to hear questions from the viewers. If you want, you can e-mail your questions here!

Tune in for Coverage of the Case Against Casey Anthony on TruTV!

I've received word that Beth Karas will be on In Session on Monday, December 8 doing three one-hour specials on the case. They will be broadcast from 10-11, 12-1, and 2-3 ET. Beth will also be covering the hearing live on December 11.

The Case Against Casey Anthony: The Week in Review

After a busy weekend of poring over the latest document dump and the new information released the previous week, the Anthony camp fired back. Cindy Anthony announced on Monday, December 1, that her Yahoo e-mail account had been hacked.

According to Kathy Belich of WFTV, she received four suspicious e-mails from Cindy. She notified her by text message and then forwarded them to the FBI for further investigation.

The FBI asked Eyewitness News not to reveal the details of emails because of their investigation. They include exchanges between Cindy Anthony and her spokesman, her private investigator, and even the PR person for Kid Finders, angry with Eyewitness News after exposing their founder has a criminal background.

There has been talk all over the internet about this, needless to say. Some believe she was hacked, others think Cindy may have accidentally sent out those e-mails. Either way, I am amazed that she kept sensitive e-mails on a Yahoo account. There are also rumors that some of the information is sensitive to the defense case. Unfortunately, if a third party such as Cindy is privy to such information, it is no longer covered by attorney-client privilege. It will be interesting to see if anything comes out of the FBI investigation.

The Anthony family maintains there is a possibility that the "hackers" have ties to Ocala and possibly some of the protesters. According to Dominic Casey, Anthony's' private investigator:

"It would be a connection between Ocala and Orlando or several protesters that we did run background checks on throughout that period. As to me saying it would be attributed to them, not what I'm saying, but possibly an Ocala to Orlando," said Dominic Casey, Anthonys' private investigator.

Later Monday night, Dr. Lawrence Kobilinski reported on Nancy Grace that it was probable that the defense might have to ask for a delay in the trial as he had not yet had the opportunity to examine the evidence.

Dr. Koblinski is one of the three scientific experts to comprise the entire witness list for the defense. The evidence he needs to examine is the hair root showing decomposition. At present, the hair is housed at the FBI labs in Quantico, VA. At the hearing last week, Judge Strickland ruled he could make arrangements with the lab to examine the evidence. I should hope that Mr. Baez is working hard to make that happen. At the hearing, the prosecuting attorney stated that more testing could happen and the hair needed to stay in Virginia. Shipping the evidence to Orlando for examination and shipping it back and forth posed a danger to the chain of custody.

Dr. Kobilinski is based in New York City. If I recall correctly, it is about a five hour drive or train ride to Quantico. Mr. Baez would be to an advantage cost-wise to send Dr. Kobilinski to Virginia instead of Orlando, FBI willing.

Tuesday began with an announcement by Leonard Padilla that he intends to return to Blanchard Park on Christmas Day with Jesse Grund's father, Richard for a vigil for Caylee. He also announced that he had already raised $50,000 from private donors to continue the search he began in November.

The Anthony family returned the ball by making an announcement that they had "big" news!

First, "...members of Kid Finders said they've had a third witness come forward to tell them they also saw a little girl who looked like Caylee in an Orlando mall last month.

Then, "Caylee's grandparents, George and Cindy Anthony, said a big development in the case is on the way. George Anthony wouldn't elaborate much further, but said a team of private investigators are working on a new lead that could lead to the discovery of the girl. "

According to George,

"There is just a lot of positive things that are still happening. A lot more people are coming forward because they can see some progress of bringing Caylee home and it's pretty awesome stuff. I can't be too specific with you but we believe we're close," he said. "

Apparently, any brown-haired, 3-year-old little girl is fair game for the Anthony family. As for me, I'm still waiting to see the photograph of Casey, Caylee, and "Zanny" that they have been hunting for somewhere out there.

Also on Tuesday, it was reported on WFTV that the family had still not reported the alleged hacking incident to police despite the assertion by Dominic Casey that "they are outraged and planned to report the intrusion to the Marion County Sheriff's Office."

After a break on Wednesday with no publicity about the case, Thursday thundered in with the release of 7 DVD's by the OCSO jail. They show the visits between Casey and her parents and her brother, Lee. These visits occurred in July and August during her first incarceration on felony child abuse charges and before she was bailed out by Leonard Padilla. Since her arrest on murder charges, Casey has had no visits from her family. Viewing the videos clearly explains why!

Casey shows her control over the entire situation. Her parents tip-toe around her, possibly to avoid angering her and shutting her down. In the long run, they learn nothing new and those of us watching learn about how Casey operates. Listening to Casey talk to her brother Lee is like listening to a foreign language. I'm going to have to learn Anthoneese!

I'm looking forward to seeing the analysis of some of these tapes when they are hashed out on In Session Monday!

The week closed out on Friday with the announcement that the State will not seek the death penalty in the case.

Prosecutors last month told WESH 2 News they were not sure they had enough aggravating circumstances to convince a jury to recommend the death penalty. In its notice to the court on Friday, the state attorney’s office simply wrote that “it is not in the best interest of the people of the State of Florida to pursue the death penalty.”

The Anthony family fired back with a statement through their representative.

"In response to the state's intent not to seek the death penalty came as no surprise to us this afternoon," the statement said. "Our family believes Caylee Marie is still alive and our efforts have not lost focus to the objective of bringing her home. Today's announcement only supports our theory that our granddaughter is still with us, and we will continue investigating all tips and leads that support our position despite what the authorities continue to say."

Hello? She's still facing life without parole! The only difference I can find is that Jose Baez will probably continue as her lead attorney. In addition, George and Cindy Anthony, as well as their spokesperson Michelle Bart are rapidly losing credibility with their constant "exciting news" press releases. It's hard to believe them anymore. They've gone to that particular well too many times.

The final news of the week came when it was announced that prosecution had added to their witness list. The new total is 144 witnesses. The revised list has not been published yet. It should be interesting to see what names have been added.

The Case Against Casey Anthony: Motions Hearing Tuesday and the Circus Continues

The case against Casey Anthony will return to court Tuesday, November 25. The State's Attorney will argue for a gag motion for all those involved. This motion will be opposed by defense attorney Jose Baez, the Orlando Sentinel, and WFTV.

In addition, the defense has filed motions for discovery. They are asking for Amscot records for employees as well as work schedules. They are also seeking records of the calendars and time lines compiled by investigators. Also being sought are crime scene reports and photographs.

Yet another motion requests "all bench notes, reports, and photographs concerning any forensic evidence the FBI has received and processed in this case," documentation of the chain of evidence for the evidence, as well as the microscopic slides, including the hair studies. The defense wants all the records from the "Body Farm" studies and all communications about the result. The defense is also asking for all tips received as well as K9 information including the training manual and veterinary records.

Finally, Baez has made a motion to be able to bring his laptop into the jail for his conferences with Casey. He claims the new policy allows only public defenders to bring laptops into jail.

It should be a fascinating hearing.

The Circus Continues

With their new spokesperson, Michelle Bart, George and Cindy Anthony have continued to state that Caylee is alive. On Sunday, November 16, Ms. Bart announced that she planned to hold a press conference to show evidence that Caylee is still alive. She indicated that leads placed the toddler had been seen at the Orlando airport during a three day period.

Later that day, after the weekly family vigil for Caylee, Bart announced that the presser had been moved until later in the week so that the Anthony attorney, Mark Nejame, could be present. Eventually, the presser was cancelled when NeJame resigned as their attorney. In a letter that was gracious and thoughful, NeJame pointed out that

"I believe that the singular person out of the 6 billion people in the world who holds the key to finding Caylee is her mother, Casey Anthony. Although I was quite successful in resolving a multitude of matters, I am unable to go further to help George and Cindy find Caylee in my current role. I can only provide my best advice and must respect any client's prerogative to do what they deem is best, whether they choose to follow my guidance or not. However, there is little value or use I can provide to any client if they choose to act and comment at will.
In the end, the Anthonys publisized a picture of a little girl they thought may be Caylee. The family PI is investigating the lead.

In his letter, NeJame stated that he respected the Anthonys' right to believe that Caylee is alive, and with that I would agree. However, I do believe that the family needs to remember the rights of others to their own privacy. I certainly hope that they leave the leads to the PI and not subject other families to not have their children's pictures spread throughout the press and the internet.

There is so much more that happened this week. The OCSO announced they will no longer follow tips on live searches. WESH reported that

Sheriff's Office spokesman Carlos Padilla said they are confident that FBI lab tests on evidence found in Casey Anthony's car prove Caylee is dead. He said that is backed up by the grand jury's murder indictment of Casey Anthony. "We cannot continue to look when we have no evidence whatsover that she's alive," he said.

The battle will continue. The OCSO will move on to other cases while the State's Attorney and his staff prepare for trial. George and Cindy will continue in their own search with the help of the KidFinders Network, which has now come under scrutiny by the press.

Part of the circus this week has been the accusations made against Dennis Milstead, a co-founder of the organization along with his wife Sherri. WFTV's Kathy Belich confronted the couple in Orlando with mug shots of him and his criminal record.

Then, Dr. Henry Lee joined the defense team and inspected Casey's car.

Leonard Padilla has been offered $200,000 for the video rights to the dive search. That money would sure hire a good amount of dive time!

The FBI videos of interviews with George and Cindy Anthony were released. For those who viewed them all, we learned more about Casey, Cindy and George. If you are following the case, most of them will provide new information.

I'm sure there is more, I do hope some of you will add to my collection.

For Caylee's sake, I wish that the events leading up to the trial of her mother Casey for murder would be more dignified. It almost seems as though people forget sometimes that in this entire situation, this little girl's memory needs to be treated with utmost dignity.

Casey's Struck Out Again!

Casey Anthony, rearrested.

Casey Anthony Arrested Tonight During Protest in Front of Parent's Home.

The sight of Casey Anthony being led to a police car tonight was the culmination of two very tense days.

Thursday, August 28th:

A sheriff’s official announced that the air samples tested by the Body Farm indicated that a decomposing human body had been in the trunk of Casey Anthony’s car.

Cindy Anthony, accompanied by Tim Miller of EquuSearch stopped by the Orange County Sheriff’s office. She’d invited the group to search for her missing granddaughter.

Cindy went outside and hammered many "No Trespassing" signs into her front lawn while excoriating the press. She calls them maggots and a lot of other things. She defended her daughter and said that she had personally spoken to a guy who said that the car had no odor of decomposition. This is possibly the guy who stated to LE that he had a bad cold that day and couldn't smell anything.

Friday, August 29th:

Orange County State Attorney Lawson Lamar indicated to the press that the DNA evidence recovered in the case indicates that Caylee is dead.

Casey’s attorney, Jose Baez, managed to convince bounty hunter Leonard Padilla to allow Casey to remain out on bond for a while longer. Perhaps it was to get Casey to cooperate with the police in the location of her daughter.

The prosecutor’s office released e-mails which show that Baez had asked for limited immunity for Casey to provide Caylee’s location back on July 25. They’ve extended the offer until Tuesday, September 2.

Earlier today, George Anthony lost his cool and went after people sitting in lawn chairs on the public easement in front of his house. George's pastor had to separate him from the much smaller man.

A group of protesters picketed the house with their signs.

Tonight on Nancy Grace with guest host Jane Velez-Mitchell, a group of police cars pulled up in front of the house and one pulled up onto the lawn. Investigators entered the house.

Casey was taken from the house in handcuffs on live TV!

At a press conference later in the evening, it was announced that Casey had been arrested for forgery using friend Amy’s checks in a Target and a bank. The videos of these transactions showed that Caylee was not with her at the time. The bond for these offenses is $3000.

Because she was already out on bond, Casey will have to appear before a judge Saturday morning at 11:30. This judge may review her current bond situation and make changes.
