Casy Anthony Ordered to Serve 1 Year Probation
Judge Belvin Perry ruled today that Casey Anthony must return to the Orlando area by noon, August 26th, 2011 to serve one year of probation for her check fraud conviction.
WESH.com reports:
In his order, Perry cited a survey that found Anthony was the most hated person in America. Perry ruled that the department of corrections must keep Anthony's residential information confidential. Perry said in the order he did not want any information released that could lead to the discovery of her location.
It will be interesting to see how long Casey's residential information remains private.

It's $$$ Day! How much will Casey Anthony's defense team get?
Money will be the one and only issue discussed. According to Judge Perry's ORDER, the defense is to be prepared to provide information about the budget for the case which, among other items:
...an estimate of the number of hours to be expended by expert witnesses and whether those witnesses can comply with JAC rates.
InSession has just announced that they will be airing the hearing live. I'm sure all the regular outlets will air the hearing as well.
As for the civil case hearing yesterday, it was literally over before it began. There was a video feed, but no sound. Later on, WFTV reported that:
During a pre-trial hearing Tuesday afternoon, a judge delayed the start date for the civil trial Casey Anthony is facing.
The trial had been scheduled for June 14, but because of things not being completed, rulings still awaiting decisions and more information to review, both parties said they would not be ready for the June date.
Instead, the judge said that the trial wouldn’t start until the first quarter of next year, but a date has not been set.

Anthony's lawyers are asking the judge to seal all state records indicating how her defense is funded.
In a new motion, Anthony's attorney, Jose Baez, argues public disclosure of invoices they submit for reimbursement will lead to "rampant speculation as to the defense strategy."

Both motions were filed by Jose Baez yesterday at 4:18 PM.
The first motion is very simple. It states that the JAC is a State agency and is subject to public access. He then indicates that the JAC allows records to be sealed if a a court order is obtained, although he cites no rules or statutes.
His reason is stated in the 4th paragraph (the second #3).
Documents and requests for funding will lead to endless speculation as to the Defense strategy for defending Miss. Anthony and could ultimately affect her right to a fair trial.
The second motion asks the Court's permission to use out-of-state experts. Throughout the motion, Baez makes reference to the fact that these experts have already spent many hours working on the case and going over discovery. It would be a waste of the State's money to have Florida experts start from the beginning.
All of the experts mentioned are willing to work for the fee stipulated by the JAC. Experts specifically named in the motion are:
Ms. Jeanene Barrett - Mitigation Specialist
Mortimer Smith - Investigator
Other than those two, the rest are listed under Out Of State Expert Witnesses.
As usual, there is a portion of this motion which I find especially interesting. In this case, it is paragraph 18 in the expert witness section. It provides a window into Baez' interpretation of the case.18. The natural progression of this case through it's (sic) twists and turns has left all parties never knowing what will happen next, much less being able to anticipate the opposing parties next move, at least from a defense standpoint.
I find this part quite interesting because Baez is saying that it's the State that is causing him to never know what is coming next. I'd contend that the State has even more difficulty guessing what the defense will pull next.
What started out as a Child neglect case quickly catapulted into a homicide investigation to a First Degree Murder Indictment without a body, to one with a body, to a full blown Death Penalty Case. The argument being that it was extremely difficult to anticipate what type of case will ultimately go to trial?
I would guess that the constant changing of the nature of the case was that Casey Anthony was the one who didn't report her child missing for 31 days (child neglect). It was her car that reeked of death. (homicide) Once Caylee's remains were found with duct tape over the face, we were up to a death penalty case.
The last sentence there leave me baffled and confused as it starts as a statement and ends as a question.
The fact is that this case has had as many twists and turns as there have been lies and deceit by Ms. Anthony and her supporters.

Casey Anthony: The Defense Files More Motions - Part 3
According to he article:
George Anthony, whose daughter Casey is awaiting trial on murder charges in her daughter's death, "testified at deposition in a manner that, to the recollection of the undersigned, was materially inconsistent with his grand jury testimony on some points," the motion filed by Assistant State Attorney Jeffrey L. Ashton said.
Ashton wants a judge to allow him to view that testimony and, if his suspicions are correct, unseal the information and provide it to Casey Anthony's defense.
As of now, the motion hasn't been posted on any news site, so all I can say is that it seems George Anthony has now been put on notice that "inconsistencies" in testimony of a substantial nature will not be accepted by the prosecution.
Moving on to the last two defense motions reminds me of how many times we have heard that George and Cindy Anthony haven't been able to visit with their daughter for nearly a year. The reason they haven't is a cause for much discussion and speculation throughout the Internet. Some say that Casey Anthony has no interest in seeing her parents for a multitude of reasons. Others are of the firm opinion that Jose Baez wants to keep Casey insulated from her family. There are even other theories, but the fact is that none of the players in the family drama wants the videotapes to be released to the public.
In a motion entitled Defendant's Motion For a Protective Order Directing Orange County Jail To Destroy Videos of Family Visits, Jose Baez and Andrea Lyon begin by making an interesting series of statements, most of which deal with Casey's meetings with her attorneys. They mention that she is chained around the stomach during interviews with her attorneys and does not present a danger to them. They also indicate that there are two guards posted nearby who have a clear view of the meeting. I'm not sure why these statements are even in this particular motion; they deal with her attorneys and not her family visits.
There are also a couple of statements having to do with the fact that this is a death penalty case which makes it much more stressful for Casey. Most interesting here is the statement that:
4. In an ordinary trial, the jail is responsible for Miss Anthony's general well-being. In a high-stress situation such as a capital trial, the jail should also be held responsible for her emotional well-being.
It is this statement which really hits the target as to the reason Baez and Lyon are making their motion.
Indeed, the motion asks the Orange County Jail to refrain from:
1. Saving any video and/or audio taping Miss Anthony's visits or phone calls with family;
2. Disclosing to anyone anything that occurred in the meetings or communications with family.
I would be very surprised if Judge Strickland were to agree with the defense on these items. When there was a hearing about the video of Casey's reaction to the news that the remains of a child had been found, Strickland did seal the video. It could be used as evidence in trial. When and if it occurs, the video could be unsealed.
Be assured that the representative for the jail will also be there to indicate that authorities will not treat Casey any differently than any other person in the jail, even though she faces the death penalty. I am very sure there have been other inmates who have awaited trial with death penalty implications who did not receive such special treatment. I'm sure their videos are available to the public through the Sunshine Laws and so will Casey's. Her problem is that this case is very bizarre and fraught with drama. Anyone who has listened to Casey call home her first night in jail and viewed the jail visitation videos will attest to that fact.
I do believe there is the possibility that the judge may order family visitation videos be sealed and only be made public if they were to be used as evidence in the trial. The same could be true for any phone calls. He may take into consideration considering the long memorandum attached to the motion by Andrea Lyon.
If you have time, read the memorandum. It points out that Casey is under a great deal of stress and needs the comfort and support of her family. In addition, the family needs time to work through the situation and help in developing mitigation.
Personally, it sounds to me as though the family should visit via teleconferencing with a family therapist in attendance to negotiate through the hazards of this family's dysfunction. The problem with all of this desire for privacy is that there is no expectation of privacy in a jail and we can be sure that detectives will be actively monitoring every visitation. That is something they have done in the past and will continue to do in the future.
The final motion also deals with video monitoring. In the motion entitled Defendant's Motion For A Protective Order Prohibiting Orange County Jail From Videotaping Attorney Visits, Baez and Lyons ask again for more privacy. I believe the first couple of sections from the previous motions were meant to be here as they dealt with the fact that Casey was not a danger as she was chained and that there were guards on duty with a clear view of the meetings.
I don't think this motion will prevail because, as has been stated before, it is jail policy to tape these interviews for the protection of not only the attorneys, but the "residents" of the jail as well. As it is, Baez has already had a few run-ins over his behavior during conferences with Casey and it's no coincidence that Baez has used visits to (illegally) pass letters to Casey.
Nevertheless, Baez and Lyon are asking Judge Strickland to order the jail to:
1. Immediately cease and desist from monitoring and/or disclosing any communications between Casey and her attorneys or attorney's agents;
Would this mean that the two guards with a clear view of the meetings mentioned in the other motion would have to turn their backs?
2. Immediately cease and desist from video and/or audio taping the Defendant and Defendant's counsel while meeting:
I do believe there is no audio taken during these meetings.
3. Immediately cease and desist from to anyone anything that occurred in the meetings or communications with counsel: (sic)
If you can figure out the missing word(s) here, I suppose this is in reference to some of the previous disclosures made about the inappropriate behavior during meetings?
4. Destroy all video or audio tapes or reports or other methods of memorializing meeting between the attorney and client that occurred on any other dates besides those already turned over for December 11, 2008;
5. Any and all other relief that is within the power of this court.
That's a tall order!

Hearing tomorrow in Zenaida Gonzalez Case: Casey Anthony seeks to have suit dismissed
In recent depositions, both George and Cindy stated that they had never seen the babysitter but knew she was a “10" while the plaintiff isn’t. Apparently, that’s all the testimony it will take to have the suit dismissed if Casey’s lawyers prevail.
On the other hand, Gonzalez’s attorney, Keith Mitnik stated in the article that he doubted the suit would be dismissed and that, "There could be some fireworks."
In addition, the Morgan and Morgan firm has recently filed a new document entitled PLAINTIFF’S PROFFER IN SUPPORT OF ADDING CLAIM FOR PUNITIVE DAMAGES AGAINST DEFENDANT CASEY ANTHONY AND INCORPORATED MEMORANDUM OF LAW.
To briefly summarize the motion to file an added claim for punitive damages, the Morgan & Morgan firm stated:
...Caylee’s grandmother, Cindy Anthony, called 911 when her daughter Casey Anthony, Caylee’s mother, would not tell here where Caylee had been. Cindy had not seen her granddaughter for weeks and became very alarmed when she admitted that she smelled the odor of a “dead body” in the trunk of Casey’s car.
The motion goes on to recount how Casey had told the investigators that she had left Caylee at the Sawgrass Apartments (on June 16). It also states that this Zenaida Gonzalez had ridden to the same complex to view an apartment on June 17.
Leasing agent Harry Garcia filled out a guest card, including the names of two of Plaintiff’s children, Ms. Gonzalez had ridden to the property in a car with New York plates. This detail, along with others, subsequently ended up in part of the ever-evolving description of the supposed kidnapper...
The motion continues with the details of the way in which this Zenaida had been identified and questioned by investigators.
According to police reports, Casey Anthony was shown a photo pack containing Plaintiff’s photo and Casey Anthony did not identify her...
The document continues with the “Jail Defamation And Subsequent Publishing.” This section goes to the heart of the motion. You may remember from the depositions and jail videos of Casey with her parents, that Casey denied being shown a photo of this Zenaida Gonzalez. Casey also gave her mother permission to publish that information. Shortly thereafter, Cindy repeated this information in an interview.
In addition, when Casey answered the interrogatories for the case, she wrote her name and went on to claim the Fifth Amendment privilege on all the other questions. She refused to state that the Zenaida Gonzales pictured was NOT the person she described.
It’s interesting that in Casey’s countersuit, she claims to have been shown the picture and denied this was the correct person. When it comes time to repeat something she states in her counter-suit, she refuses!
I’ll be watching for any live coverage of tomorrow’s hearing and will cover it here on Trials & Tribulations if possible.
Meanwhile, we have another hearing in Judge Rodriguez’s courtroom this week. I believe it is for the 21st. Unfortunately, I checked his calendar and it does not include any hearing for that date yet.
At this point, all four Anthonys have motions to compel filed against them. Let’s hope that the good judge will rule on them all then!

Casey Anthony: The Motions Continue
In the second motion, the defense asks for DNA information, bench notes, reports, and standards. This lengthy motion was filed on January 28. Read motion here. I originally discussed this motion prior to the January 30 hearing. If you would like to read a summary, check it out here.
Fox35 also reported that an affidavit concerning DNA reports and procedures was also filed by Dr. Larry Kobilinsky, an expert for the defense. This could possibly be related to the previously mentioned defense motion. As of this time, this document has not been made available to the public. If and when it does, I will post a link here.
The third motion to be discussed at the hearing will be one submitted by George and Cindy Anthony's attorney, Bradley Conway, on March 3. The motion asks the judge to not allow the release of the document recovered from Anthony's car following his suicide attempt on January 22.
In the motion, Conway indicates that the release of the document because it contains very personal information intended for nobody other than Mr. Anthony's family. He also states that disclosing this document now would create substantial risk of unnecessary annoyance and embarrassment...
Conway also indicated that the document is related to George Anthony's suicide attempt and used to "Baker Act" him. As such, he believes that this is medical information protected by statute.
Since this is an evidentiary hearing, Casey Anthony will have to attend.
WESH has already announced it will televise the hearing and I would expect other stations to carry it as well.

The Case Against Casey Anthony: New documents to be released this week
The state released over 1,100 pages of evidence to Casey Anthony's defense team on Monday. According to a source close to the investigation, test results from the FBI crime lab on the duct tape found on slain toddler Caylee Anthony's skull are in that new batch of evidence. When asked by WESH 2's Bob Kealing if Casey Anthony's fingerprints were on the duct tape, a source with direct knowledge of the investigation said, "This is not going to be good news for the defense."
This is what we have been waiting for. The State's Attorney's office is planning to release the documents to the public on Wednesday.
Let's hope we get the answers to so many of the questions we have been asking.
In other news, Jose Baez, Casey's lead attorney in her defense has been hospitalized with stomach problems. Wishing him a speedy recovery...

Casey Anthony: Motions, motions, and more motions!

I have posted all the motions available and given a brief summary of each. Today, two more motions have been released to the public.
The first motion was filed by the Department of Corrections asking Judge Strickland for a clarification of his Order of January 23. In the Motion for Clarification, the DOC indicates that
...this court did not consider the effect such an order would have on prisoner transport operations...

We should learn Thursday if Casey Anthony will be in court Friday for the latest hearing. Judge Stan Strickland is expected to rule on motions filed by Anthony's defense lawyers trying to keep her from appearing.
The second motion was filed yesterday by Jose Baez. It is an Amended Motion to Compel DNA Bench Notes/Reports and Standards. The 24 item motion asks for a superabundance of records from all labs. The information asked for includes
All updated Curriculum Vitae of all experts, analysts, examiners, criminalists, and lab personnel... (1)
All ASCLAD documents for the past twelve years. The list of items included is quite voluminous.
(2)
All government contracts, grants and communications between Oak Ridge Laboratories involving the section relating to Dr. Arpad Vass for the last twelve years. (16)
All contracts, records of payments, documents, memos or any written items including but not limited to drafts, proposals or otherwise involving any media shows by, with, and/or between the Orange County Office of the Chief Medical Examiner, and/or Dr. Jan Garavaglia or her agents or related media entities including but not limited to Discovery Channel, Discovery Health, or its media company that produces on behalf of the same. I highly recommend reading this particular motion. If granted, I can't begin to imagine the amount of paperwork this will entail! I'm thinking something about the size of the Encyclopedia Britannica!
Also, based on an article this morning in the Sentinel, the Motion to Recuse will not be addressed tomorrow.

State of Florida's Motion to Strike Defense Witness List This motion, originally filed by the State on December 9, states,
On November 20, 2008, the defendant files a document titled Defense Witness List listing three (3) witnesses under "Category A: and otherwise incorporating "the entire State's Witness List by reference."
The motion goes on to cite case law to support the motion. By failing to provide a list of witnesses to the prosecution, they are hindering the ability of the prosecution to depose these people.
There is also a Motion To Inspect Crime Scene, filed on January 20. Apparently, the owner of the property hasn't contacted the defense to give them permission to inspect the property and Baez wants the judge to issue a subpoena.
The defense originally filed a motion on December 11, which was heard in an emergency hearing on December 12. At that time it was ruled that, since the remains had not been officially identified, he did not have the standing for this to be allowed. By Wednesday, December 17, we were treated to videos showing Dr. Lee, Linda Kenney-Baden, and other defense experts of the newly formed "Dream Team" peering at the crime scene from behind the yellow crime-scene tape. The scene was released by law enforcement on December 20.
Next up is a Motion to Compel Screen Shots or Printouts Concerning the Forensic Examination Done on the Computer of Ricardo Morales. Ricardo is the ex-boyfriend of Casey's who had a romantic picture of a man and a woman with the caption, "win her over with chloroform" posted on his MySpace page. In the motion, Baez states,
"While the State is now in the process of providing the hard drive to Morales' computer and have not yet provided a copy of the screen shots, printouts, Excel charts or forensic analysis of the deleted files. We are entitled to know what it was that the State felt was not "incriminating" in order to compare it to any computer analysis that we may wish to perform in this regard."
Obviously, the chloroform is the issue here! Is Ricardo heading under the bus with this?
The next motion is the AMENDED APPLICATION FOR SUBPOENA DUCES TECUM. In this motion, Baez is again asking Texas Equusearch records. As you may recall, this motion was originally heard during the January 8 hearing. It was pointed out that this organization is in Texas and not under the jurisdiction of the Florida courts. (When have we heard this before?) In addition, Tim Miller had not been notified and was not in court. According to this motion, Baez has asked for all the information and has not been given them.
I hope that Tim Miller appears in court with his attorney, Mark NeJame for this. Although I can't find a transcript, I recall Tim stating, with some anger, that Baez wouldn't get a "scrap" of paper from him.
The next motion deals with Casey appearing at future motions hearings. At the January 8 hearing, Judge Strickland ordered Casey brought from the jail to attend the hearing since Baez had not had her sign a waiver. He also stated that Casey needed to sit through the entire hearing that day.
The judge went further on this issue by issuing an Order on January 23 which, while allowing that Casey had the legal right to file such waivers, she would have to appear at all such hearings in the future.
On January 27, Baez filed a NOTICE OF OBJECTION to the Judge's order. Included with the order is a signed waiver from Casey as well as an article from the Sentinel which stated
Anthony sported a dark blue jail-issued jumpsuit and jail-issued flip-flops. Officials shackled her wrists and ankles. Her dark hair fell just past her shoulders, much longer than her first mug shot taken in July.
In Baez' motion, he states that in this little paragraph,
... the media have focused on the appearance of the Defendant and have generated unsubstantiated rumors regarding the Defendant's physical condition further lessening the integrity of the process...
The motion has more to say, but it seems that Baez wants to keep Casey away from the court room since this is such a "circus" of a case. I can't help but wonder, though. Is he afraid of Casey's demeanor? Is he afraid she will have an emotional meltdown? Is he afraid of what she will learn about her case during these hearings? We shall see!
I wonder if Baez will have Casey ready to appear "just in case" or if he will be totally defiant of the judge's order and stand by her waiver. Either way, there could be some fireworks.
The last two motions are essentially Jose Baez temper tantrums, in my opinion.
Baez filed a Motion For Sanctions against the prosecuting attorneys. This motion deals with evidence from the case sent to Dr. Neal Haskell and Dr. David Hall. Baez states that these two gentlemen are not on the State witness list. In addition, when Dr. Lee examined the contents of the white plastic trash bag found in the trunk of Casey's car, the white bag was not made available to him and the defense was not notified where it was. Apparently, it, along with hair and vegetation from the bag had been sent to Dr. Haskell in October, 2008. There is a lot more in the motion, but you can read it for yourself at the link!
There are no specific sanctions mentioned in the motion.
The last motion available now is a real hum-dinger. It's an EMERGENCY MOTION TO RECUSE. Baez accuses the prosecutors of,
...interfering with the 8th Amendment Right of Counsel...
...on January 26, 2009, it was reported that the Florida Bar Association has "told Eyewitness News (www.wftv.com) that 'someone from the State Attorney's Office forwarded the news releases (about Jose Baez related to alleged remarks made about the prosecutor and/or entertainment deals going into the pocket of Baez) and that's why the Bar opened an investigation...
This Prosecutor's Office anonymously reporting if true... is egregious behavior.
Again, you have to read this motion for yourself to believe it. Listening to the legal experts on TV last night, I have to agree with what they were saying. Baez wants the entire prosecution team, from Lawson Lamar on down, to be removed from the case. I can only wonder what Strickland is going to say to this!

The Case Against Casey Anthony
New Documents Released
Reading just the headlines on the usual Florida television sites today pretty much says it all. There was duct tape over Caylee's mouth, complete with a heart sticker. A Pooh blanket, clothing, and a toy were also found with what remained of this sweet little girl.
I've only begun to wade through the documents which include information detectives received from some of Cindy's co-workers. I was surprised to learn that after retrieving the car from Amscot, Cindy went back to work. Her supervisor suggested she go home and call the police, but Cindy said she had a lot of work to do. The supervisor then went to her supervisor who told Cindy to go home.
From the co-workers, detectives learned that Casey would drop Caylee off at her job so she could go to "work." In addition, co-workers heard all about a Nanny named Zanny, the trip to Tampa, and the car accident. The supplementary report where you can all read this for yourself can be found in a number of places.
So far, I've identified 284 pages of information. Not all the sites have the exact same documents, so try more than one.
Also today, the defense filed a motion to inspect the crime scene. Apparently, the defense has had no response from the owner of the property who lives in Winter Park. There is no date set for a hearing on this.

Catching up on the case against Casey Anthony
COMMENTARY
I've been gone for a while, but I've been closely following the case against Casey Anthony. With Caylee's positive identification by the medical examiner, I was hoping that the circus surrounding this case would end and that the serious business of court procedure would flow more smoothly.
That did happen for a short time. The defense wasn't allowed to "assist" the CSI team and the FBI in the painstaking sifting of soil at the scene. Henry Lee was limited to the view he could get from his camera, behind the yellow tape. I wasn't surprised that the defense then turned around and ignored that piece of land where little Caylee's remains were found. They knew there was nothing more to find.
Now, Caylee's tiny bones rest in a funeral home, waiting for Dr. Werner Spitz to examine them on his own. Since Jose Baez requested the documentation from the "autopsy" conducted by Orlando County Medical Examiner, Dr. Jan Garavaglia, little Caylee's funeral has had to be put on indefinite hold.
Today, the news about the case has focused on those remains. According to WESH,
The discs include X-rays and photos of her body, which were supposed to be delivered to the defense under a court's order. But in a new motion, the Orange-Osceola State Attorney's Office said it has concerns that the images will be reproduced and sold, according to WESH 2 reporter Bob Kealing.
In this motion, the state argues that substantial licensing fees have been paid for pictures and video of Caylee taken while she was alive. That is why prosecutors want the judge to place special restrictions on digitized images of the remains before they hand them over to attorney Jose Baez and his defense team.
In court documents prosecutors say they have three discs ready to hand over, but they want the judge to order Baez not to reproduce those images in any way. They also want restrictions placed on whom Baez can show the images.
I don't know if the prosecution will prevail in this instance, but the motion does bring up a number of questions that have never been answered about the proceeds from the licensing of those pictures and videos. Who did receive all the money?
The Baez Law Firm also got a verbal spanking from civil judge Jose Rodriguez. From WFTV
Casey Anthony's defense team wanted to avoid having her testify in connection with the civil trial, which could then be used against her in her criminal trial. Baez had hoped the deposition could be delayed until after the criminal trial.
During Tuesday morning's brief meeting, the judge refused to hear the request and scolded Jose Baez's team for personal attacks against Morgan and Morgan, the law firm representing Gonzalez, and said Baez was taking the profession to a new low.
The judge told Baez to stick to the law and said that the request for a hearing didn't follow proper protocol and that there was not enough notice given to make such a request.
Apparently, Jose Baez and his attorneys haven't learned proper procedure for filing motions despite assistance provided them by Judge Stan Strickland last year! I hope they all get on a learning curve about basic court procedures.
As far as the verbal spanking that the Baez Law Firm received, perhaps they also need to learn that it's not nice to snipe at the opposition in the actual counter suit. Paragraph 7 of the suit states:
The Plaintiff and her attorneys knew this when they filed said lawsuit yet went through with this frivolous lawsuit so as to generate publicity and press for their law firm. A law firm, it should be noted, which utilizes highway billboards in order to advertise their services. This lawsuit allows them to generate further publicity for their law firm without paying thousands of dollars for a billboard.
Somehow, I'm not quite following that legal argument! Indeed, I'm thinking just WHO here is benefitting from the publicity in this case the most.
As I recall, the whole issue in this situation is that after Morgan filed the case on Zenaida Gonzalez' behalf, The Baez Law Firm filed a counter suit. According to Morgan, that left Casey Anthony open to deposition in support of her counter suit. From what I understand, Casey's taking the 5th to questions asked of her would cause her to lose her suit. It's a very bizarre situation!
There will be a hearing on the matter this Thursday, January 8.
Meanwhile, things have been pretty quiet on the Anthony Family Front. That's probably because they are all now listening to their lawyers for a change. Oh, and their all waiting for full immunity before interacting with Law Enforcement again.
It does seem like the circus is starting up again. I haven't even begun to mention the ways. The Meter Reader, the Psychic, Leonard Padilla, etc., etc., etc.!

The Case Against Casey Anthony: Pre-Trial Hearing Tomorrow
If I am able, I will post a summary.
Mid-Week Summary
This week has been a virtual tornado of Baez and Anthony spin. Sunday evening, the Anthony family announced a temporary cessation of vigils for Caylee until the New Year.
At the same time, Cindy opined about the decision of the prosecution not to seek the death penalty:
"I don't think they have much of a case at all," said Cindy following a candlelight vigil for Caylee at the Eastside Baptist Church in Orlando. "I don't think they have a death penalty case at all, so I wasn't surprised."
She added that the whole notion of raising a death penalty case against her daughter was ridiculous. "I think we should be out there looking for Caylee and not focused on a few lies Casey told to the Sheriff's Office. The evidence will speak for itself."
It's interesting that Cindy refers to her daughter's "few lies" when those following the case know that virtually everything Casey said was a lie!
Monday morning, Jose Baez appeared on the Today Show. The broadcast began with the coverage of the extensive pretrial publicity and the difficulty of finding an impartial jury. Apparently, asking for a change of venue would cause a delay in the trial, something the defense does not seem to want. Baez still is doing media research to make a decision on the change of venue issue.
In his interview, Jose Baez contended that
"We believe that Caylee is alive, and what we want to do, as her attorney I have a responsibility to Casey, and that is to do the best job possible, so it's not an issue of rushing to get a trial just because we expect a body to be found,"
Apparently, he believes a speedy trial is necessary to absolve Casey of guilt and get her out of jail as soon as possible. I also noticed that Mr. Baez is now using the royal "we" nowadays.
Baez also indicated that he believes the "leaks" from law enforcement were put out in the public well before they should have been. He also stated the jailhouse videos released last week show an emotional Casey who is crying all the time. Cindy Anthony had also applauded the release of the tapes saying that:
"I said from the very beginning, if they would have shown those tapes people would have seen that she does have emotions," Cindy Anthony said. "She's not a cold, calloused person like everybody wants to paint her out to be. She's a desperate, loving mother."
Did Cindy actually view the videos, or is she doing this from memory? I haven't heard ONE expert say that's how Casey came off in those tapes. Pathological liar, deceptive body language, severe family dysfunction: That's what I observed and what was reported in the news by any number of experts.
Baez also claimed the public only has a "fraction" of the story. My goodness! All the thousands of pages of information released under the Florida Sunshine Laws are only a fraction! Does that mean Casey has much more to say? If she does, she'll have to take the stand at the trial. According to the defense witness list, there are only three scientific experts listed. There don't seem to be any witnesses to buttress Casey's lies and swear to her veracity.
Also on Monday, Jose Baez petitioned the court for an Application For Subpoena Duces Tecum for the release of various security tapes, including those from the infamous "Caylee sighting" at the Florida Mall. Apparently, the Anthony family can't get them for themselves without one. According to George Anthony, there is a 50-50 chance the little girl is Caylee.
Hello? How did he come up with that? OK, I get it, it's Caylee or it isn't! I suppose that the same logic would apply to almost any little brown-haired girl with bangs and a pony-tail? If there is a math wizard out there anywhere, please explain George's math to me!
The last news reported Monday of any value was the fact that Jose Baez still hasn't picked up the DVD's with the rest of the tips he's been begging for. According to WFTV:
Baez's spokesman said the sheriff's office has misled them in the past, implying the abandoned discs don't contain tips of Caylee sightings. He said that despite the defense having not looked at them yet. He also said that Baez "could maybe already know what's on those discs."
I personally believe he knows they won't find anything of value on them and he doesn't want to pony up the money he already owes the court for the last batch of tips. Also, his staff of 40 that he alluded to at the hearing last week just doesn't want to go down to the courthouse to sort them out for free.
Tuesday's news was replete with announcements about Cindy and George's journey to California on Wednesday to appear live on the Larry King Show. Of course, that trip is secondary to another hunt for Caylee. This time, they plan to visit a restaurant in Newport Beach where there was yet another Caylee "sighting."
On Nancy Grace, Leonard Padilla chimed in with yet another of his opinions:
Everybody knows when she died, and the 30 days is not a secret anymore ... Don't be surprised if Orange County or the FBI don't drop it on us here that they've got the body somewhere," Padilla said.

The Case Against Casey Anthony: The Week in Review
After a busy weekend of poring over the latest document dump and the new information released the previous week, the Anthony camp fired back. Cindy Anthony announced on Monday, December 1, that her Yahoo e-mail account had been hacked.
According to Kathy Belich of WFTV, she received four suspicious e-mails from Cindy. She notified her by text message and then forwarded them to the FBI for further investigation.
The FBI asked Eyewitness News not to reveal the details of emails because of their investigation. They include exchanges between Cindy Anthony and her spokesman, her private investigator, and even the PR person for Kid Finders, angry with Eyewitness News after exposing their founder has a criminal background.
There has been talk all over the internet about this, needless to say. Some believe she was hacked, others think Cindy may have accidentally sent out those e-mails. Either way, I am amazed that she kept sensitive e-mails on a Yahoo account. There are also rumors that some of the information is sensitive to the defense case. Unfortunately, if a third party such as Cindy is privy to such information, it is no longer covered by attorney-client privilege. It will be interesting to see if anything comes out of the FBI investigation.
The Anthony family maintains there is a possibility that the "hackers" have ties to Ocala and possibly some of the protesters. According to Dominic Casey, Anthony's' private investigator:
"It would be a connection between Ocala and Orlando or several protesters that we did run background checks on throughout that period. As to me saying it would be attributed to them, not what I'm saying, but possibly an Ocala to Orlando," said Dominic Casey, Anthonys' private investigator.Later Monday night, Dr. Lawrence Kobilinski reported on Nancy Grace that it was probable that the defense might have to ask for a delay in the trial as he had not yet had the opportunity to examine the evidence.
Dr. Koblinski is one of the three scientific experts to comprise the entire witness list for the defense. The evidence he needs to examine is the hair root showing decomposition. At present, the hair is housed at the FBI labs in Quantico, VA. At the hearing last week, Judge Strickland ruled he could make arrangements with the lab to examine the evidence. I should hope that Mr. Baez is working hard to make that happen. At the hearing, the prosecuting attorney stated that more testing could happen and the hair needed to stay in Virginia. Shipping the evidence to Orlando for examination and shipping it back and forth posed a danger to the chain of custody.
Dr. Kobilinski is based in New York City. If I recall correctly, it is about a five hour drive or train ride to Quantico. Mr. Baez would be to an advantage cost-wise to send Dr. Kobilinski to Virginia instead of Orlando, FBI willing.Tuesday began with an announcement by Leonard Padilla that he intends to return to Blanchard Park on Christmas Day with Jesse Grund's father, Richard for a vigil for Caylee. He also announced that he had already raised $50,000 from private donors to continue the search he began in November.
The Anthony family returned the ball by making an announcement that they had "big" news!First, "...members of Kid Finders said they've had a third witness come forward to tell them they also saw a little girl who looked like Caylee in an Orlando mall last month.
Then, "Caylee's grandparents, George and Cindy Anthony, said a big development in the case is on the way. George Anthony wouldn't elaborate much further, but said a team of private investigators are working on a new lead that could lead to the discovery of the girl. "According to George,
"There is just a lot of positive things that are still happening. A lot more people are coming forward because they can see some progress of bringing Caylee home and it's pretty awesome stuff. I can't be too specific with you but we believe we're close," he said. "Apparently, any brown-haired, 3-year-old little girl is fair game for the Anthony family. As for me, I'm still waiting to see the photograph of Casey, Caylee, and "Zanny" that they have been hunting for somewhere out there.
Also on Tuesday, it was reported on WFTV that the family had still not reported the alleged hacking incident to police despite the assertion by Dominic Casey that "they are outraged and planned to report the intrusion to the Marion County Sheriff's Office."After a break on Wednesday with no publicity about the case, Thursday thundered in with the release of 7 DVD's by the OCSO jail. They show the visits between Casey and her parents and her brother, Lee. These visits occurred in July and August during her first incarceration on felony child abuse charges and before she was bailed out by Leonard Padilla. Since her arrest on murder charges, Casey has had no visits from her family. Viewing the videos clearly explains why!
Casey shows her control over the entire situation. Her parents tip-toe around her, possibly to avoid angering her and shutting her down. In the long run, they learn nothing new and those of us watching learn about how Casey operates. Listening to Casey talk to her brother Lee is like listening to a foreign language. I'm going to have to learn Anthoneese!
I'm looking forward to seeing the analysis of some of these tapes when they are hashed out on In Session Monday!
The week closed out on Friday with the announcement that the State will not seek the death penalty in the case.
Prosecutors last month told WESH 2 News they were not sure they had enough aggravating circumstances to convince a jury to recommend the death penalty. In its notice to the court on Friday, the state attorney’s office simply wrote that “it is not in the best interest of the people of the State of Florida to pursue the death penalty.”
The Anthony family fired back with a statement through their representative.
"In response to the state's intent not to seek the death penalty came as no surprise to us this afternoon," the statement said. "Our family believes Caylee Marie is still alive and our efforts have not lost focus to the objective of bringing her home. Today's announcement only supports our theory that our granddaughter is still with us, and we will continue investigating all tips and leads that support our position despite what the authorities continue to say."
Hello? She's still facing life without parole! The only difference I can find is that Jose Baez will probably continue as her lead attorney. In addition, George and Cindy Anthony, as well as their spokesperson Michelle Bart are rapidly losing credibility with their constant "exciting news" press releases. It's hard to believe them anymore. They've gone to that particular well too many times.
The final news of the week came when it was announced that prosecution had added to their witness list. The new total is 144 witnesses. The revised list has not been published yet. It should be interesting to see what names have been added.

Grand Jury to Consider Homicide Charges Against Casey Anthony!
Local 6 reports:
The State Attorney's Office is planning on presenting its case to a grand jury on Tuesday, according to Local 6 News. The grand jury will then decide if prosecutors have enough evidence to charge Anthony, the report said.
It is not known if it will be a murder or manslaughter charge, Local 6 reported.
Deputy's have stated they think 2-year-old Caylee Anthony is dead. Prosecutors will have an uphill battle since little Caylee's body has not been found.
Meanwhile, the Orange County Sheriff's Office released more documents and video surveillance today pertaining to the fraud and theft charges. On the videos you can see images of Casey Anthony writing checks at several local stores.

Casey Anthony: Suspect!
I had promised myself I wouldn’t write any more about this case until something big happened. I’ve gone about my life, followed up on news releases, chatted with my buddies, and tried my best to put the missing little girl, Caylee Anthony out of my mind.
It hasn’t worked. This little girl haunts my dreams and follows me wherever I go. Sweet, innocent little Caylee never realized she wasn’t totally loved and cherished by her mother. She didn’t realize she was a pawn between her mother and her grandmother. She didn’t realize she was in the way of her mother’s "alternate lifestlye."
Now, it’s been 119 days since she visited her great-grandfather at his assisted living home on Father’s day. It’s been 119 days since she sat his lap, gave him a kiss and rested against his chest It has probably been 119 days since that last loving, peaceful moment Caylee had in her all too short life.
If you listen to Leonard Padilla, June 15 was the day that, after the visit to the nursing home, Cindy Anthony confronted her daughter about her thieving ways. He essentially tossed blame to Cindy for Casey’s departure:
PADILLA: They have to get away from the truth. They can`t live with the truth. Cindy should go back to the realization that she is the one that caused Casey to leave the house that night. If she would realize that .
GRACE: I disagree with you, Leonard. You don`t make somebody else do something. Casey - Mom Casey Anthony was already leaving the house and shacking up with one guy after the next. Where she was keeping the child, I don`t know. But her mother did not make her do these things. They may have had an argument, but she was acting on her own volition.
PADILLA: Cindy put her hands around Casey`s throat and practically choked her out that night. It scared the hell out of Casey. It had never happened before.
It’s a real shame that the Anthony’s hadn’t followed through with their plans to gain custody of Caylee before this day. If they had followed through, Casey would have had to leave the house on her own that night.
Where Casey spent that night, and the people she spoke to then, we don’t know. What we do know is that it was the last time Caylee was seen alive.
Now, her mother’s situation has been changed from Person of Interest to Suspect. This tells us now that there has been a crime more serious than felony child neglect. It tells us that the investigation is circling in around Casey, only Casey.
We have to be patient now, very patient. We have to trust the OCSD and the FBI to continue in the investigation and pin down every moment, every witness, every piece of forensic evidence. It will be a difficult case to prove without a body and it will take time. In this case, I have faith in the system. They will put together their case and present in a court of law.
For the peace of those who truly loved her, I pray that Caylee is found and justice satisfied for this precious little girl.

Case Anthony Offically Called a Suspect in Daughter Caylee's Disappearance
It's about time that OCSO changed her status to suspect. Virtually every thing that has come out of her mouth about her daughter's disappearance has been proven to be a lie. Let's hope that this latest statement by OCSO means that murder charges are not far behind.
Anthony's attorney, Jose Biaz, would not comment beyond saying it didn't matter what the OCSO called her.
Earlier today Anthony entered a written "not guilty" plea on the fraud charges. She will most likely not appear at an arraignment on those charges because of the written plea.
Ever since Casey Anthony has been in and out of jail on various charges, the drama in the street outside her house has been a growing problem for the Sheriff's office, and the peace and quiet of her neighbors. There have been 138 calls from the Anthony family themselves and 158 from the neighbors.
The homeowner association in the Anthony neighborhood has twice tried to get a judge to issue a temporary injunction on the protesters, and move them to an empty lot. Both requests have been unsuccessful. The Anthony's and their attorney, Mark Nejame went so far as to make a plea to the Mayor and several Commissioner's for help in dealing with, ". . .the miscreants, these lawbreakers. . ." as Nejame called them. He went on to say, "I won't dignify them by calling them protesters. They were agitators, and unfortunately and sadly, they just thought it was best for them and their neighbors and their community not to do them at their home anymore."
The Commissioners felt that there was plenty of money in the Sheriff's budget to park an on duty squad car at each end of the street where the Anthony's live at a cost of approximately $4,000 a month. If I was a taxpayer in Orange County, I'd be mighty pissed at this waste of resources. One of the solutions I thought was long past due, the Sheriff's Office finally asked the Anthony family to "move the prayer vigils" from in front of their home to inside their home or their back yard.
Earlier today the Anthony's announced that the prayer vigils would now be held in a local church starting Sunday. Finally forkin' time if you ask me.

The Circus Continues at the Anthony House

Just when you think things can't get worse at the Anthony house, they do. There was another altercation involving Cindy and George Anthony and the protesters outside their house early Thursday morning. George Anthony is demanding justice! How forkin' funny is that? During the rukus, a protester attempted to drag George off his property and Cindy came to his rescue wielding a baseball bat. You might think you were watching an episode of The Twilight Zone, or even bad reality TV, but you're not. It's on the morning news. All you have to do is tune in first thing for the latest antics at the Anthony home the night before.
If Casey was still in jail and her parents would stifle themselves, this level of crazy probably would not be happening. I think for the public safety, Casey's bond should be revoked.
Before this latest debacle, OCSO have been to the Anthony home over 40 times. The amount of time officers are spending on missing Caylee is affecting other cases before the court. What is sad is that the Anthony family has lost their focus. It's no longer on Caylee.
The 911 Call
A surreal moment in time. Casey Anthony calls 911. Who would have thought? donchias says, "She finally figured out how to dial 911."
Partial transcript of her second call:
Casey: "There are protesters still outside of our home. We already called about an hour and a half ago and it took officers 30 minutes to get here,"
"The protesters are now banging on our garage door and they've still been throwing things at our windows and our garage and now the media is here. My father is going outside and there is going to be a fight. So, please can you send people down here? There is now a physical altercation. You need to send vehicles immediately."
911: "It is getting physical?"
Casey: "Yes, it's getting physical right now."
911: "You see them physically fighting?"
Casey: "Yes, I see them physically fighting. We have surveillance."
911: "OK, do you know if there are any weapons?"
Casey: "I don't know if there are any weapons. I know that my father is outside and so is my mother. So, send as many people as you possible can." (Casey conveniently doesn’t mention that her mother is carrying a baseball bat.)
911: "And, who is this?"
Casey: "They need to be arrested because this can't keep happening. We already had six or seven officers out here for almost 45 minutes and they did not do anything. And they are the same punks that were out here all night throwing stuff at our house." (Notice how Casey avoided telling the 911 operator who she was. I think Casey would fall into that “punk” category herself.)
911: "OK, stay on the line with me.”
Casey: "I absolutely will, but they need to hurry up. They were…they just left not that long ago." (Gee Casey, you want LE to cooperate with you, but you won’t cooperate with them. Hummmm.)
911: "The police officers left?"
Casey: "The police officers just left at about 1 a.m. A media van just pulled up and that is when all of this started happening," Anthony said.
911: "About how many people are out there?"
Casey: "There are at least a dozen people and now two media vans. And there is actually more people walking in from across the street." (I watched the video and I can see where Casey does tend to embellish the facts. The six individuals on the video became over a dozen. donchais says, “Well, it is Casey’s version of the truth.”)
911: "How many people are actually involved in the altercation?"
Casey: "Channel 2 news has everything on tape already.
911: "How many people are involved in the altercation?"
Casey: "There are at least a dozen people. My mom is out there now spraying people with the hose. My father is…they are trying to get them off the property. They are also trespassing on our property." (In the video, it’s George, not Cindy.)
911: "Is it still happening?"
Casey: “They are still standing on the property. Yes, they are out there recording it."
911: "So, what about the physical altercation? Is it over?"
Casey: "It's already over, yes.”
911: "So, it is no longer physical?"
Casey: "It is no longer physical. But it was already physical. It's the protesters."
911: "Who are you?"
Casey: "I'm the resident. We have everything on tape, thanks to channel 2 and also our home surveillance." (Resident lunatic. Notice how she still avoided telling the 911 operator who she was.)
911: "Was there any weapons involved?"
Casey: "Not that I can see, no.” (Again, she avoids telling 911 her mother is carrying a baseball bat. I did not see a single protester with a weapon on the video.)

Case: "This needs to be taken care of immediately. Both of my parents were hit by the protesters." (A woman did grab George’s shirt. Cindy might have been pushed.)

Mommy Dearest – Cindy and Casey Anthony, and Cindy Rewriting History
~WIRE HANGERS?
Remember the famous Faye Dunaway, wire hangers scene? I think ‘wire hangers’ is appropriate for both Cindy and Casey; neither of these women are up for ‘Mother of the Year’!
Cindy, with all her recent tantrums and tongue-lashings – well, I can sure picture her running through the house screaming ‘wire hangers’ and Casey - in refusing immunity - pretty much has her jaw ‘wired’ shut!
Growing up in that insane asylum, were Casey and Lee playing the roles of Christina and Christopher Crawford? Ultimately, did little Caylee then take over the role of Christina? It may not be too far-fetched!
Rewriting History
July 15 - 911 call “it smells like there’s been a dead body in the damn car”
July 21 - On Greta, Cindy begs national media to help find Caylee
July 23 - On Nancy Grace, commenting on cadaver dog hits in Anthony backyard and car trunk - Cindy says bag of pizza in car for 19 days and the same dog that cleared our house cleared the car
July 24 - Cindy leaving jail tells media she’s not worried about the smell in car
July 29 - Cindy blames media for putting false information out and she is blaming and holding the media responsible for Caylee still being missing
Throughout August, Cindy is still appearing on media broadcasts. (I swear, I was going to stick a pen in my eye if I watched more videos catching Cindy’s ever-change story!)
August 28 – Equusearch begins searching for Caylee at the behest of Cindy
August 29 - Cindy lashes out at media. Says of Tim Miller, “ I want him to do a search around here to satisfy all of you leeches, parasites and all of you maggots.”
Well, that was certainly a good reason to waste the time and resources of Equusearch!
WESH - Cindy again questioned about the smell in the trunk of the car - Cindy Anthony said she now has a new theory. "I felt rotten. Whatever it was, something decomposing in there, maybe someone put a body in the car after it was towed to the tow yard."
September 2 - Tim Miller, Equusearch on CNN with Nancy Grace, “right now, you know, it appears as though I probably need to pull off of this search.” Miller stopped short of saying he was getting no support or information from the Anthony family.
Then, Cindy Anthony, who just can’t resist an opportunity to be in the limelight, called in to Nancy Grace and told the audience that she didn't want people out searching for the remains of Caylee and it is a waste of time to search for a body because Caylee is alive and in Texas, Mexico or Puerto Rico. A month ago, she thought maybe New York, but she doesn’t think that anymore!
Cindy on the evidence there was a body in the car: Are we talking about urine? I mean, I myself, put dirty diapers back there from Caylee until we’ve gotten home and throw them away.
Cindy on the cadaver dog hit in the backyard: “You know when the dog hit on Caylee’s playhouse, I asked them is it because she peed in her playhouse?”
I have the distinct impression that Cindy has a dartboard with media responses de jour. Each morning when she wakes up, she throws a dart and wherever it lands, that’s her response for the day!
Seriously, if Cindy isn’t halfway into a nervous breakdown, she’s on a fast train, heading for one!
She has now heard the DNA and air evidence that proves a body was in the car, seen the 400 some-odd pages of police records that include statements and interviews and the family has been served subpoenas to appear as witnesses in Casey’s criminal trial set for November.
If that isn't enough to send you around the bend, I don't know what is!
This is a family who so desperately want to believe Caylee is alive. The only way they will believe she's dead is if they see Caylee’s body, which I’m afraid may never be found.
Maybe - just maybe - reality is beginning to set-in, which might explain a lot about Cindy’s behavior!

Casey Anthony Continues To Sit In Jail With Her Mouth Shut
Meanwhile, mixed stories continue to surface as to whether or not little Caylee is alive or not. All of these stories have appeared in the past 7 hours!
WESH: For the first time on the record on Sunday, Orange County investigators acknowledged that recent FBI lab tests indicated that Caylee Anthony's body was in her mother's trunk and that the child is dead.
Orlando Sentinel: "Since we've gotten things back from the FBI lab, we know that we're probably looking for a body," said Sgt. John Allen. "We're to the point in the investigation where we think it'd be good to go back and retrace some of our steps."
Local 6: Orange County sheriff's deputies said Sunday they are not ready to confirm that missing Caylee Anthony is dead or that her body was in the trunk of her mother's car.
While I’ve lost all hope that Caylee is alive, I don’t think the media is helping matters with the conflicting reports! It’s almost like listening to Cindy Anthony!

Hopefully, we will get some clarification from the Sheriff's Office today.
On Sunday, a Sheriff's Office helicopter was sent up with EquuSearch's infrared equipment to help map the search area and look for things such as recently disturbed areas or fresh tire tracks.
Volunteers searched and area north of Orlando International Airport. The area is roughly seven miles from the Anthony home.

No Get Out of Jail Card for Casey Anthony

The Fifth District Court of Appeals denied the request to have Casey Anthony's bond lowered.
The request was denied without comment or explanation just before 3 p.m.
Judge Stan Strickland set her bond at $500,000 on July 22 and her attorney Jose Baez, was hoping to have that amount lowered to $10,000.
Florida Attorney General Bill said that he opposed the bond being lowered, saying that Strickland did not abuse his discretion by setting the bond at $500,000.
The appeals court also ordered Casey’s psychiatric evaluation sealed. The judge reviewed it before making Wednesday's decision.
Jose Baez, said he was shocked by the decision made by the appeals court Wednesday to not lower his client's bond.
"We just got word a few moments ago that it was denied," Baez said on Wednesday afternoon.
Baez is working with attorney Mike Walsh, who specializes in appeals.
"It's disappointing. It's very disappointing," Baez said.
Baez also said of the attention being paid to the case, "It's been nuts. It's been crazy."
"This family has impressed me. They're a united family. I've said this. Any way you look at, she's a victim," Baez said of Caylee's grandmother Cindy Anthony.
Baez is as nutty as his client!
