I'm getting myself ready for the hearing tomorrow and swimming through the pages and pages of motions that have been filed in the last couple of weeks. I believe I've managed to separate the motions for the murder trial from the fraud trial.
Although Judge Strickland plans to hold a status hearing for the fraud trial tomorrow, I have to believe that the shear volume of the motions precludes discussion at the hearing which already encompasses five motions from the criminal trial.
In last week's article I discussed the State's response to the "spoliation" issue which the defense wants to use to have the entire case dismissed. I said at the time that, since the defense had yet to reply to the State's response, that the defense will argue that they don't need to present any more information than they have.
Well, I was right. In the Defendant's Reply To State's Response to Motion To Dismiss Due to Spoliation of Evidence, the defense reiterates its original position and refers back to the memorandum it filed with the original motion.
I'm not an attorney, so I will stay away from the esoteric legalese in the motion as well as the discussion as to which case law applies to what and get to some of the basic facts.
The motion does include a more detailed explanation as to why they believe LE acted in bad faith by excavating the crime scene. What it boils down to is:
As usual, I will cap my discussion of this reply to a reply by quoting my favorite part:
The technological changes since Youngblood and the corresponding changes in Florida case law and policy support her contention that, given the prevalence and importance of DNA testing and other forensic science, police and other State agents should be presumed to understand that they are crippling a defendant's ability to defend herself when they destroy an entire crime scene...
There was no way LE could completely unearth all of the evidence and tiny fragments of bones from the scene without removing the nasty vegetation and sifting through the soil.
Had the investigators not done so, and many precious remains had been missed, the defense would be telling the State that they had botched the investigation.
I hope that Judge Strickland can rein in all the attorneys who will be present. There could be some rather impressive pyrotechnics in the courtroom tomorrow.

Here are some interesting facts about the hearing tomorrow. According to reporter Tony Pipitone, of Local 6, "Strickland did not call the motion to dismiss to be heard at next week's hearing, but did set for hearing the state's move to have that motion to dismiss cleared from the record because it is flawed."
In addition, "Pipitone said it looks like Strickland is trying to clear the clutter over the defense's claims that the case should be dismissed. Strickland also did not call the defense's motion to bar the state from seeking the death penalty to be heard next week."
The State's Response To Motion To Preclude The Death Penalty Procedures is now available online. While it isn't posted to be discussed at tomorrow's hearing, I'd like to share the opening parts of the document authored by Assistant State's Attorney Jeff Ashton:
In her Motion, through counsel, the Defendant, once again, has filed a legally insufficient motion which the State would move this court to deny the motion on the pleadings and avoid the grandstanding at a hearing before the media which appears to be the sole purpose behind the filing of the motions...
I believe Mr. Ashton hit the nail on the head here, considering the recent media blitz by the defense and the airing of a 48 Hours episode about the case tomorrow. Apparently, the defense will be splashing their stuff all over the media yet again. The article at the link has a number of incredible quotes (and I mean "incredible" in both meanings of the word).

George Anthony Goes Missing, Found in Daytona Beach, Hospitalized, Jose Baez: Charges to Bar Association Clarified
George Anthony has been under a great deal of stress due to the murder of his granddaughter Caylee and the subsequent investigation and arrest of his daughter Casey for homicide.
The father of Casey Anthony, who is charged with first-degree murder in the death of her daughter, Caylee, has been taken to a hospital for psychiatric evaluation after he was reported missing and having suicidal thoughts, authorities said.
George Anthony was reported missing late Thursday night from his Orange County home but was located a few hours later at the Hawaii Motel on U.S. Highway 1 in Daytona Beach.
"He had text-messaged family members that he wanted to end his life," Daytona Beach Police Chief Mike Chitwood said.
Local 6 News reported that a suicide note was also found in George Anthony's car. The note is in the possession of the Orange County Sheriff's Office.
"I'm being told by sources close to the investigation that the note included wording like 'I want to go be with Caylee,'" Local 6 News reporter Jessica D'Onofrio said.
George Anthony's wife, Cindy Anthony, and their attorney, Brad Conway, reported him missing after he failed to arrive at a 4 p.m. Thursday meeting with them, officials said.
"George has been through a lot. The entire Anthony family has been through a lot. George is OK. Thank God," Conway said. "Had it not been for a cooperative effort between Orange County and Volusia County, I don't know what the outcome would have been."
According to Brad Conway, the family attorney, (She's doing) as well as can be expected, but she's good," Conway said. "George is safe, and he's with us, so it's all good."
According to the article, Casey was informed of the situation.
This situation shows clearly the mental toll Casey's behavior has taken on the family. Police had removed a gun purchased in September from the wheel-well of his vehicle. At that time, Casey had been bailed out for the second time and there were angry protesters outside the house. At the time, there was a great deal of discussion as to whether the gun, which George had purchased in August, was for the protesters or for himself.
George has been taken into custody under the Florida Baker Act which provides for a 72 hour psychiatric hold. He was taken to Halifax Medical Center for observation.
Let's hope that George gets the help he needs at this difficult time.
Baez Bar Complaints Being Investigated
According to WFTV,
The Bar has confirmed it has two open investigations. The first involves Jose Baez's PR firm, Press Corp Media, run by Todd Black. In the past, Baez's spokesperson has released statements to the media about State Attorney Lawson Lamar and prosecutors
In one release, it states, "Lawson Lamar is facing tough opposition and having a missing baby is a perfect springboard for free commercial time." Another release states, "The prosecution has manipulated and shamelessly used the media in the reporting of false distorted … evidence."
Sources told Eyewitness News officials are looking into whether or not Baez violated a rule that states lawyers can't make false statements about judges or legal officials.
The second investigation deals with Baez possibly violating advertising rules, where he claimed to have more credentials and experience than he really did.
The two complaints are in addition to an informal complaint made to the State Attorney's Office. Sources told Eyewitness News there are allegations that Baez maybe using entertainment deals to fund his defense team.
I hope that Baez's ethical issues are cleared up soon and that the discovery process moves on so that there can be a trial. In the end, this case isn't about the circus, the media, Jose Baez, George and Cindy Anthony. It's about justice for a precious child who lost her life. It's all about Caylee.

Grand Jury to Consider Homicide Charges Against Casey Anthony!
It looks like it's finally going to happen folks. I know y'all have been waiting for this for quite some time. The State's Attorney's office is working towards a murder or manslaughter charge against Casey Anthony.
Local 6 reports:
The State Attorney's Office is planning on presenting its case to a grand jury on Tuesday, according to Local 6 News. The grand jury will then decide if prosecutors have enough evidence to charge Anthony, the report said.
It is not known if it will be a murder or manslaughter charge, Local 6 reported.
Deputy's have stated they think 2-year-old Caylee Anthony is dead. Prosecutors will have an uphill battle since little Caylee's body has not been found.
Meanwhile, the Orange County Sheriff's Office released more documents and video surveillance today pertaining to the fraud and theft charges. On the videos you can see images of Casey Anthony writing checks at several local stores.

The Circus Continues at the Anthony House

Just when you think things can't get worse at the Anthony house, they do. There was another altercation involving Cindy and George Anthony and the protesters outside their house early Thursday morning. George Anthony is demanding justice! How forkin' funny is that? During the rukus, a protester attempted to drag George off his property and Cindy came to his rescue wielding a baseball bat. You might think you were watching an episode of The Twilight Zone, or even bad reality TV, but you're not. It's on the morning news. All you have to do is tune in first thing for the latest antics at the Anthony home the night before.
If Casey was still in jail and her parents would stifle themselves, this level of crazy probably would not be happening. I think for the public safety, Casey's bond should be revoked.
Before this latest debacle, OCSO have been to the Anthony home over 40 times. The amount of time officers are spending on missing Caylee is affecting other cases before the court. What is sad is that the Anthony family has lost their focus. It's no longer on Caylee.
The 911 Call
A surreal moment in time. Casey Anthony calls 911. Who would have thought? donchias says, "She finally figured out how to dial 911."
Partial transcript of her second call:
Casey: "There are protesters still outside of our home. We already called about an hour and a half ago and it took officers 30 minutes to get here,"
"The protesters are now banging on our garage door and they've still been throwing things at our windows and our garage and now the media is here. My father is going outside and there is going to be a fight. So, please can you send people down here? There is now a physical altercation. You need to send vehicles immediately."
911: "It is getting physical?"
Casey: "Yes, it's getting physical right now."
911: "You see them physically fighting?"
Casey: "Yes, I see them physically fighting. We have surveillance."
911: "OK, do you know if there are any weapons?"
Casey: "I don't know if there are any weapons. I know that my father is outside and so is my mother. So, send as many people as you possible can." (Casey conveniently doesn’t mention that her mother is carrying a baseball bat.)
911: "And, who is this?"
Casey: "They need to be arrested because this can't keep happening. We already had six or seven officers out here for almost 45 minutes and they did not do anything. And they are the same punks that were out here all night throwing stuff at our house." (Notice how Casey avoided telling the 911 operator who she was. I think Casey would fall into that “punk” category herself.)
911: "OK, stay on the line with me.”
Casey: "I absolutely will, but they need to hurry up. They were…they just left not that long ago." (Gee Casey, you want LE to cooperate with you, but you won’t cooperate with them. Hummmm.)
911: "The police officers left?"
Casey: "The police officers just left at about 1 a.m. A media van just pulled up and that is when all of this started happening," Anthony said.
911: "About how many people are out there?"
Casey: "There are at least a dozen people and now two media vans. And there is actually more people walking in from across the street." (I watched the video and I can see where Casey does tend to embellish the facts. The six individuals on the video became over a dozen. donchais says, “Well, it is Casey’s version of the truth.”)
911: "How many people are actually involved in the altercation?"
Casey: "Channel 2 news has everything on tape already.
911: "How many people are involved in the altercation?"
Casey: "There are at least a dozen people. My mom is out there now spraying people with the hose. My father is…they are trying to get them off the property. They are also trespassing on our property." (In the video, it’s George, not Cindy.)
911: "Is it still happening?"
Casey: “They are still standing on the property. Yes, they are out there recording it."
911: "So, what about the physical altercation? Is it over?"
Casey: "It's already over, yes.”
911: "So, it is no longer physical?"
Casey: "It is no longer physical. But it was already physical. It's the protesters."
911: "Who are you?"
Casey: "I'm the resident. We have everything on tape, thanks to channel 2 and also our home surveillance." (Resident lunatic. Notice how she still avoided telling the 911 operator who she was.)
911: "Was there any weapons involved?"
Casey: "Not that I can see, no.” (Again, she avoids telling 911 her mother is carrying a baseball bat. I did not see a single protester with a weapon on the video.)

Case: "This needs to be taken care of immediately. Both of my parents were hit by the protesters." (A woman did grab George’s shirt. Cindy might have been pushed.)

Casey Anthony Continues To Sit In Jail With Her Mouth Shut
There is an offer on the table from the State Attorney's Office if she chooses to speak about what happened by Tuesday. The deal comes off the table at 9 am.
Meanwhile, mixed stories continue to surface as to whether or not little Caylee is alive or not. All of these stories have appeared in the past 7 hours!
WESH: For the first time on the record on Sunday, Orange County investigators acknowledged that recent FBI lab tests indicated that Caylee Anthony's body was in her mother's trunk and that the child is dead.
Orlando Sentinel: "Since we've gotten things back from the FBI lab, we know that we're probably looking for a body," said Sgt. John Allen. "We're to the point in the investigation where we think it'd be good to go back and retrace some of our steps."
Local 6: Orange County sheriff's deputies said Sunday they are not ready to confirm that missing Caylee Anthony is dead or that her body was in the trunk of her mother's car.
While I’ve lost all hope that Caylee is alive, I don’t think the media is helping matters with the conflicting reports! It’s almost like listening to Cindy Anthony!
Kitty Malone says: I'm confused and IRKED! You know what I'm saying? How can 3 local papers have 3 different reports? Crack head writers? Okay, that was harsh, but come on! Please!
Hopefully, we will get some clarification from the Sheriff's Office today.
On Sunday, a Sheriff's Office helicopter was sent up with EquuSearch's infrared equipment to help map the search area and look for things such as recently disturbed areas or fresh tire tracks.
Volunteers searched and area north of Orlando International Airport. The area is roughly seven miles from the Anthony home.

Casey Strikes Out!

Anthony remained jailed late Wednesday and will likely be released Thursday.
Yes, Casey Anthony is now out on bond after a week-long circus including Leonard Padilla, Bounty Hunter Extraordinaire, Tony Padilla the Bondsman and various and sundry Florida bail bonds people. They’ve plunked down $50,000 and guaranteed the rest of the half-million bond. The other $200 in bonds are chump change for these dudes.
Now, Casey is going home to Mom and Dad. She’ll be welcomed like the Prodigal Daughter, at least at first. After all, except for a brief stop home on June 24 to get some clothes and have the stolen gas cans in the trunk of her car discovered by her father, they haven’t seen their Princess in person since July 16, the day she was arrested on charges of child abuse and not telling the truth, and nothing but to law enforcement officers.
What will Casey find when she gets home? First, there will be the monitoring device firmly clamped onto her ankle. There will be a new phone line in the house, just for her. Too bad she won’t be able to call her friends on it. Nope, that phone will just be there to keep her in the 150-foot radius.
Now, she could go out to the front yard. Whoops, no, she can’t. There are a bunch of reporters with their trucks and tents out front ready to get a scoop from her. She could also go into the back yard and take a swim in the pool. No, that might bring up some bad memories for her. She could dig the bamboo out. No, Caylee’s not around to step on it.
Next, there will be her bondsman baby-sitter to make sure she doesn’t run. Excuse me, Leonard Padilla said it was for her and her family’s safety! There are a lot of threats out there. Personally, I’m not worried about her security or her safety. The aforementioned press presence should thwart anyone who might want to get to her. The news helicopters overhead should keep the back yard safe, should she choose to venture there.
Of course, the 24/7 bondsman baby-sitter will need a place to sleep. I’m thinking he or she could sleep in Casey’s room. Casey can curl up in Caylee’s bed. She can spend her nights taking in all the toys and pictures of her missing child.
Then there’s the matter of Family Dynamics. We’ve all seen the meltdown of her parents. We can all agree that Cindy’s constant battles with the press were bizarre and frequently contradictory statements made for good news bites. Her father’s loss of composure at the thought that his granddaughter is dead was evident to all. These two people have had to deal with such a dichotomy. Deep down, they know that Caylee is dead. They both smelled the death-stench in the car. They both know their daughter is a foul-tempered liar. Yet, they feel the need to defend and support her.
We’ve listened to the 911 tapes and the tape of the call from Casey that first day in jail
"There is something wrong...I found my daughter's car today, it smells like there's been a dead body in the damn car," Cindy Anthony yelled into the receiver.
"Whose fault is it you're sitting in jail?" Cindy Anthony said. "Are you blaming me you are sitting in the jail? Blame yourself for telling lies. What do you mean it is not your fault? What do you mean it's not your fault, sweetheart? If you would have told them the truth and not lied about everything..."
"Do me a favor and just tell me what Tony's number is," Casey Anthony said. "I don't want to talk to you. Forget it."
This is where you see the true family dynamics in action. This is what the bondsman baby-sitter will be able to observe in person once the short "honeymoon" period wears off.
Cindy and George will want to know the truth, and Casey won’t give it to them. She’ll repeat, ad infinitum, "Jose says I can’t talk to you about it." Tempers will flare. Hopefully, some truth will emerge in the emotional explosions. We can only hope.
I’ve come to the point in this case where I really don’t care about Casey and the Anthony family. Let them live out their own drama.
What I care about and where I’m putting my faith is in the Orange County Sheriff’s Office. They have gone quietly about their business. They are not playing to the media and they’re keeping key evidence already in hand to themselves. I know that if Caylee is to have justice, they have it for her.
They aren’t giving Jose Baez anything upon which to hang his proverbial hat. On August 18, he stated on Greta VanSusteren when asked if there might be more charges added stated:
BAEZ: Well, if they're going to add the charges or increase them, our way of looking at it is -- you know, what we want to do is -- what could be a positive outcome of this is if they decide to file, obviously, more serious charges, we'd be forcing them to do something that they are not exactly ready to do yet. And any time you can get them to do something they don't want to do, it's certainly a wise move, and we're looking at that as a positive aspect of this.
Well, Jose, it didn’t work. You can have Casey "free" and they’re not going to give up any of their information to you until they’re good and ready!

What will Casey find when she gets home? First, there will be the monitoring device firmly clamped onto her ankle. There will be a new phone line in the house, just for her. Too bad she won’t be able to call her friends on it. Nope, that phone will just be there to keep her in the 150-foot radius.
Now, she could go out to the front yard. Whoops, no, she can’t. There are a bunch of reporters with their trucks and tents out front ready to get a scoop from her. She could also go into the back yard and take a swim in the pool. No, that might bring up some bad memories for her. She could dig the bamboo out. No, Caylee’s not around to step on it.
Next, there will be her bondsman baby-sitter to make sure she doesn’t run. Excuse me, Leonard Padilla said it was for her and her family’s safety! There are a lot of threats out there. Personally, I’m not worried about her security or her safety. The aforementioned press presence should thwart anyone who might want to get to her. The news helicopters overhead should keep the back yard safe, should she choose to venture there.
Of course, the 24/7 bondsman baby-sitter will need a place to sleep. I’m thinking he or she could sleep in Casey’s room. Casey can curl up in Caylee’s bed. She can spend her nights taking in all the toys and pictures of her missing child.
Then there’s the matter of Family Dynamics. We’ve all seen the meltdown of her parents. We can all agree that Cindy’s constant battles with the press were bizarre and frequently contradictory statements made for good news bites. Her father’s loss of composure at the thought that his granddaughter is dead was evident to all. These two people have had to deal with such a dichotomy. Deep down, they know that Caylee is dead. They both smelled the death-stench in the car. They both know their daughter is a foul-tempered liar. Yet, they feel the need to defend and support her.
We’ve listened to the 911 tapes and the tape of the call from Casey that first day in jail
"There is something wrong...I found my daughter's car today, it smells like there's been a dead body in the damn car," Cindy Anthony yelled into the receiver.
"Whose fault is it you're sitting in jail?" Cindy Anthony said. "Are you blaming me you are sitting in the jail? Blame yourself for telling lies. What do you mean it is not your fault? What do you mean it's not your fault, sweetheart? If you would have told them the truth and not lied about everything..."
"Do me a favor and just tell me what Tony's number is," Casey Anthony said. "I don't want to talk to you. Forget it."
This is where you see the true family dynamics in action. This is what the bondsman baby-sitter will be able to observe in person once the short "honeymoon" period wears off.
Cindy and George will want to know the truth, and Casey won’t give it to them. She’ll repeat, ad infinitum, "Jose says I can’t talk to you about it." Tempers will flare. Hopefully, some truth will emerge in the emotional explosions. We can only hope.
I’ve come to the point in this case where I really don’t care about Casey and the Anthony family. Let them live out their own drama.
What I care about and where I’m putting my faith is in the Orange County Sheriff’s Office. They have gone quietly about their business. They are not playing to the media and they’re keeping key evidence already in hand to themselves. I know that if Caylee is to have justice, they have it for her.
They aren’t giving Jose Baez anything upon which to hang his proverbial hat. On August 18, he stated on Greta VanSusteren when asked if there might be more charges added stated:
BAEZ: Well, if they're going to add the charges or increase them, our way of looking at it is -- you know, what we want to do is -- what could be a positive outcome of this is if they decide to file, obviously, more serious charges, we'd be forcing them to do something that they are not exactly ready to do yet. And any time you can get them to do something they don't want to do, it's certainly a wise move, and we're looking at that as a positive aspect of this.
Well, Jose, it didn’t work. You can have Casey "free" and they’re not going to give up any of their information to you until they’re good and ready!

A slew of press surrounded a silent lipped Casey Anthony as she was released from jail this morning. Will this latest publicity stunt by bounty hunter Leonard Padilla actually result in a resolution to this story and find missing Caylee? Time will tell.

Casey Anthony - Strike Two! Mom to Stay in Jail

Well, it’s official. Casey Anthony isn’t going anywhere soon. Yesterday, the Appeals Court denied the latest bond motion to lower her bail. Meanwhile, Casey is not accepting visits from her family and apparently not calling out either.
Casey Anthony's attorney, Jose Baez, said his client wants to talk with her family but is sacrificing for her daughter. "It's not something she wants," Anthony's attorney Jose Baez said. "She wants to see her family. She wants to talk to her family but she's willing to sacrifice that for Caylee." "I still think that to this day, the bond is excessive and tantamount to no bond at all," Baez said.
While waiting for test results, I’ve been watching the words spin and spin. It seems every time I turn around, there are more messages to unravel to get somewhere near to the truth of the matter.
With attorney Baez, I can totally understand his need to spin the information in defense of his client. That’s his job. However, members of Casey’s family have had to resort to verbal gymnastics to reconcile the fact that Caylee has been missing for nearly two months with their loyalty to Casey.
I can understand their need to make Casey appear in the best light while at the same time attempting to find Caylee. It’s a difficult position for them to maintain. However, at this point, they need to stop talking about the case to the media. It’s only muddying the waters of an already murky case.
According to WFTV: (Brother) Lee was asked if he thought his sister was being truthful. "To the best of her ability right now, I do," he said.
Translation: "My sister is a pathological liar and something in what she said may contain a nugget of truth. All I have to do is separate the lies from the truth.
Meanwhile, the grandmother of missing Caylee Anthony said she believes the missing girl may have made a call after she vanished -- which would be new information in the case. "I believe my mother also heard Caylee during that time," Cindy Anthony said. When Cindy Anthony was asked how Caylee would know her great-grandmother's phone number, she said the number was programmed into Casey Anthony's phone. A sheriff's department representative is checking to see if Cindy Anthony has ever mentioned the call before.
This is one of the most puzzling statements Cindy Anthony has made to the media. First of all, one has to assume that a two-year-old would know how to operate a cell phone. Secondly, how could the missing Caylee have Casey’s phone at the same time Casey had it? Oh, and if you’re thinking that perhaps Caylee had the phone that went missing? Sorry, not possible! Casey clearly stated she last remembered having it at Universal when she was supposedly hunting down her "friends" who knew about Casey’s disappearance.
To add to the confusion, grandmother Cindy Anthony is disputing the police’s contention that there was no phone call from the phantom nanny Zenaida Fernandez-Gonzalez at around noon on July, 15.
Cindy Anthony said she talked with detectives about a phone call that Casey Anthony said she received in which she heard Caylee in the background. According to a search warrant, detectives said phone records show that the phone call never occurred. "We discussed that with the deputies today. They're re-looking at the phone records because that's a misstatement," Cindy Anthony said.
According to Mark Fuhrman on Greta Van Susteren last night, the Anthony family only has Casey’s cell from records up to July 7 due to the fact that the phone was cut off from July 8 forward due to an overdue bill of $724. How in the world can the family know there is a "misstatement" of facts from the police when they don’t have records from the day the call was allegedly made? It’s certain that the police have the full records. I’d suggest that the Anthony’s pay the bill and get the records before they make accusations against the police!
