Bobby Cutts Murder Trial: Day Five - Part II

Afternoon session – motions

Is this just a camera built into the laptop and they've got a track ball that they're using to operate it? Is this like Gameboy5? Man! This camera operator is going to make me ill this afternoon!

I think donchais is right. The cameraman brings his kids in to operate the trackball. What in the world is he doing? And with the picture speeding up and slowing down and all the other wonky stuff you almost think Stanley Kubrick is behind the lens, and Tom Cruse will come into view momentarily.

It appears that the jury may be sequestered!

Both sides are filing motions.

Judge: Need defense to file original of motions 39 & 40.

And prosecution needs to file their originals on "the notice".

Judge: Are people satisfied that this would be a satisfactory time to file those?

Yes sir.

Judge: If we could get everything filed that hasn’t been filed.

Oh boy. The camera is no onboard a ship!

Prosecution is submitting their list of exhibits they want admitted.

State's exhibit 54, they have an objection to. That includes the divorce decree. They want that excluded because they go over and beyond the child support issue the prosecution raised. "The information is not relative."

State of Ohio?

Judge : Can those matters be redacted?

Pros. I believe so.

Defense wants aggravated burglary tossed. Trespassing in to the home was not witnessed.

Aggravated murder charge should be tossed. No intent has been shown. Again the State is relying on Ferrell’s testimony.

Court should not rely on Richard Mitchell’s statement.

Defense says Myisha’s statement that, “they got in to it” does not prove anything. This is not about a stranger coming into a home.

Prosecution has rested.

Defense case will probably take Monday and maybe some of Tuesday. Judge wants closings to start Tuesday morning if possible.

Jury will be sequestered beginning Tuesday for the length of deliberations.

So, maybe I was right! This may turn out to be a two-week after all!
